Article 5. Procedure for registration of citizens involved in Ensuring public order of the Law on the Participation of Citizens in Ensuring Public Order

Article 5. Procedure for registration of citizens involved in Ensuring public order of the Law on the Participation of Citizens in Ensuring Public Order

      1. A citizen who has expressed a desire to participate in ensuring public order shall apply to the internal affairs body with an application, to which he shall attach a copy of the identity card or passport of a citizen of the Republic of Kazakhstan. The citizen has the right to attach to the specified documents a copy of the certificate of life and health insurance.  

      2. The internal affairs body, within thirty calendar days from the date of receipt of the application, checks the citizen for narcological, neuropsychiatric and other records, after which it applies to the local executive body of the district (city of regional significance) with a corresponding petition, to which copies of the submitted documents are attached, or refuses the applicant in writing, indicating the reasons for the decision.  

      3. The local executive body of the district (city of regional significance) shall, within seven working days, consider the application received, register the citizen and register him with citizens involved in ensuring public order, and inform the internal affairs body in writing.  

     4. Citizens who have not reached the age of majority and persons in respect of whom a pre-trial investigation is being conducted or who have a criminal record that has not been expunged or removed in accordance with the procedure established by law, as well as those registered in drug treatment and neuropsychiatric dispensaries or recognized as legally incompetent or with limited legal capacity, are not allowed to participate in ensuring public order.

      5. The rejection of the application does not prevent the applicant from applying again, provided that the reasons that served as the basis for the refusal are eliminated.  

      6. The grounds for termination of a citizen's participation in ensuring public order are:  

      a citizen's statement about his unwillingness to continue participating in ensuring public order;  

      criminal prosecution;  

      repeated (two or more times during the year) commission of intentional administrative offenses;  

      departure for permanent residence outside the Republic of Kazakhstan;  

     the occurrence of circumstances precluding his further participation in ensuring public order (mental or behavioral disorder (illness), including related to the use of psychoactive substances, other illness that poses a danger to others, according to the list approved by the authorized body in the field of public health, or death).

      7. Upon the occurrence of the circumstances specified in paragraph 6 of this article, the local executive body of the district (city of regional significance), upon the recommendation of the relevant internal affairs body, removes this citizen from the register of citizens involved in ensuring public order.  

 

 

The Law of the Republic of Kazakhstan dated July 9, 2004 No. 590.

     This Law regulates public relations arising in connection with the voluntary participation of citizens of the Republic of Kazakhstan in ensuring public order.
