Article 5. State registration of encumbrances of rights to immovable Property of the Law On State Registration of Rights to Immovable Property
The following encumbrances of rights to immovable property are subject to state registration in the legal cadastre:
1) the right of use for a period of at least one year, including rent, gratuitous use, easements, the right to lifelong maintenance with dependents, rent;
2) the right of trust management, including in custody, trusteeship, inheritance, bankruptcy and others;
3) collateral;
4) arrest;
5) restrictions (prohibitions) on the use, disposal of immovable property or on the performance of certain works imposed by state bodies within their competence;
6) other encumbrances of rights to immovable property provided for by the laws of the Republic of Kazakhstan, with the exception of preferential interests.
If the tenant is the recipient of housing payments in accordance with Articles 101-1 and 101-3 of the Law of the Republic of Kazakhstan "On Housing Relations", the lease agreement is subject to state registration regardless of the period of use of the immovable property.

This Law defines the goals, objectives and legal framework in the field of state registration of rights to immovable property.
