Article 5. The rights and obligations of individuals in the field of physical culture and sports of the Law on Physical Culture and Sports

  The following basic concepts are used in this Law:

     1) a veteran athlete is a high-class athlete who has completed his sports career;

     1-1) special sports equipment – sports equipment that is a necessary component of training and competitive activities, compensating for the impaired or lost body functions of an athlete with a disability;

     2) amateur sports is a mass sports movement that gives individuals the opportunity to improve their athletic skills and achieve top results in various sports;

     2-1) sports section for children and youth – an activity to promote the health and development of athletic abilities of children and youth, conducted by a coach, a coach-teacher or an instructor in physical education and sports, organized on a regular basis;

     3) adaptive physical culture and sport – a set of sports and recreation measures aimed at rehabilitation and adaptation to a normal social environment of people with disabilities, overcoming psychological barriers that prevent them from feeling a full life, as well as realizing the need for their personal contribution to the social development of society;

     4) mass sports – a sports movement that promotes the development of physical culture among the population;

     5) unified sports classification is a system of sports titles, categories of athletes, sports coach titles, qualification categories of coaches, teaching coaches, sports judges, athletic instructors, physical education and sports instructors, which determines the skill level of athletes, coaches, or qualifications of coaches, teaching coaches, sports judges, and athletic instructors. methodologists in physical education and sports;

     5-1) the first coach is a coach who provides training (at least three years) athletes at the initial (early) stages of training high-class athletes;

 

    5-2) accompanying an athlete with a disability of the first group – an individual who, on the basis of a contract, provides support and assistance services to athletes with disabilities of the first group, with damage to the musculoskeletal system, visual impairment, intellectual disability, in need of outside care and assistance due to partial or complete loss of the ability to independently satisfy their basic life needs, self-care and (or) movement, when traveling to sports events (district, regional, national and international);

     6) physical education is a pedagogical process aimed at the formation of a healthy, physically and spiritually perfect younger generation;

     7) physical culture is an integral part of culture, an area of social activity, which is a set of spiritual and material values created and used by society in order to develop a person's physical and intellectual abilities, improve his motor activity and form a healthy lifestyle, social adaptation through physical education and development;

     8) physical training is a pedagogical process aimed at the education of physical qualities and the development of functional capabilities of a person.;

     9) a methodologist in physical education and sports (hereinafter referred to as a methodologist) is an individual with a professional education who provides methodological support and guidance for the educational and training process, conducting physical culture, recreation and sports events.;

     9-1) physical education and sports instructor – an individual with a professional education who provides practical support for the educational and training process, conducting physical culture and recreation activities, including adaptive physical education and sports;

     10) system of physical culture and sports – a set of individuals and legal entities engaged in activities for the purpose of physical education of the population and the development of physical culture and sports;

     11) specialist in the field of physical culture and sports – an individual who carries out activities in the field of physical culture and sports;

     12) authorized body in the field of physical culture and sports – the central executive body responsible for the management and intersectoral coordination in the field of physical culture and sports;

     13) physical culture, recreation and sports facilities - specially equipped (including sports equipment) facilities (playgrounds, buildings, structures) intended for physical exercise, sports and sporting events;

     14) physical culture and sports organization – a legal entity that carries out activities in the field of physical culture and sports as its main activity;

     15) The World University Games are comprehensive international winter and summer competitions held among students in various sports;

     16) coach, trainer-teacher – an individual who carries out the training process of training an athlete and directs his competitive activities to achieve athletic results.;

 

     17) disqualification of a coach, a teaching coach, a sports medicine specialist, another specialist in the field of physical education and sports, a sports judge – suspension of a coach, a teaching coach, a sports medicine specialist, another specialist in the field of physical culture and sports, a sports judge from participating in sports competitions and (or) training camps, and (or) labor (professional) activities in the field of physical culture and sports, which is carried out by an accredited sports federation for violation for violating the rules of sports and (or) for violating the regulations (regulations) of sports competitions, and (or) for violating anti-doping rules, and (or) for violating sports ethics, and (or) for violating the norms, approved by international sports organizations and (or) republican (regional) accredited sports federations;

 

     17-1) personal trainer – a trainer who provides training (at least three years) an athlete, aimed at fulfilling an individual training plan during his stay outside the national team of the Republic of Kazakhstan by sport (national team by sport);

 

     18) high–class athlete - an athlete who is a member of the national team of the Republic of Kazakhstan in a sport (national team in a sport) and (or) has a sports title not lower than "Master of Sports of the Republic of Kazakhstan";

 

     19) high–performance sports is a field of sports that provides for athletes to achieve the highest possible sporting results or victories in sports competitions.;

     20) professional sports is an integral part of sports aimed at organizing and conducting sports and entertainment events (competitions), for the preparation and participation in which athletes who choose sports as a professional activity receive remuneration in accordance with the civil legislation of the Republic of Kazakhstan.;

     21) an integrated scientific group is a group of qualified specialists created to conduct scientific, methodological, biomedical, and psychological research aimed at assessing the functional state, reserve capabilities, and psychological and technical level of an athlete's training.;

 

     22) tests of the First President of the Republic of Kazakhstan – Elbasy – a set of regulatory requirements for the physical fitness of children, youth and adults;

     23) school sports is a part of physical culture and sports aimed at the physical education of students in educational institutions of primary, basic secondary and general secondary education, their preparation for participation in sports events;

     24) school sports league is a sports movement among schoolchildren, the purpose of which is to promote the popularization of school sports and the development of one or more sports, the organization and holding of sports events with schoolchildren;

 

     25) state coach – a coach who performs functions and measures to implement the state policy for the development of a type(s) of sport in the territory of the Republic of Kazakhstan;

     25-1) state sports order – a state-funded volume of services in the field of physical culture and sports for children and youth, determined according to the methodology of per capita regulatory financing of the state sports order and placed with suppliers regardless of their forms of ownership, departmental subordination, types and types;

     25-2) the per capita standard for financing the state sports order is the standard for financial support of the guaranteed state cost of services in the field of physical culture and sports for sports sections for children and youth;

     26) an athlete with a disability is an individual who has a health disorder with a persistent disorder of body functions caused by diseases, injuries, their consequences, disorders that lead to disability, and is engaged in an accessible type (accessible types) of sports.;

     27) classification of athletes with disabilities is the process of determining by a classifier or group of classifiers a class (classification category) of athletes with disabilities in order to enable them to compete with other athletes with disabilities who have a similar level of functionality.;

     28) instructor-athlete – an athlete who carries out sports activities on a paid basis in accordance with the labor legislation of the Republic of Kazakhstan;

29) the training camp is a centralized event organized in order to improve sports skills and the quality of the training process of athletes.;

     29-1) non–Olympic sport is a sport that is not included in the Olympic Games program, has been widely developed in the global sports community and is led by international sports federations.;

 

     29-2) Olympic sport is a sport included in the Olympic Games program, recognized by the International Olympic Committee in accordance with the Olympic Charter of the International Olympic Committee;

 

     29-3) non–Paralympic sport is a sport that is not included in the program of the Paralympic Games, has been widely developed in the global sports community and is led by international sports federations.;

 

     30) The Paralympic Games are international winter and summer competitions held among athletes with disabilities who have damage to the musculoskeletal system, visual organs and intellectual disabilities;

 

     30-1) Paralympic sport is a sport included in the program of the Paralympic Games, recognized by the International Paralympic Committee in accordance with the Code of Rules of the International Paralympic Committee.;

     31) sport is a sphere of socio–cultural activity as a set of sports that has developed in the form of sports competitions and special training of a person for them.;

     32) sports discipline is a part of a sport that has distinctive features and includes one or more types (programs) of sports competitions.;

 

     33) sports reserve – athletes of youth and youth age who have the potential to achieve high athletic results;

 

     34) sports referee – an individual who has received special training and received the appropriate qualification category, authorized by the organizer of a sports event to provide refereeing in accordance with the rules of the sport and the regulations (regulations) of the sports event.;

 

     35) national sports teams of the Republic of Kazakhstan (national sports teams) – teams of athletes, coaches, domestic and foreign specialists who train and participate in international sports competitions under the National Flag of the Republic of Kazakhstan;

 

     35-1) ranking of sports – determining the level of development of sports depending on sports achievements at international sports competitions, the national and cultural traditions of the sport, the availability of human resources, the material and technical base, the mass and the characteristics of the sport, depending on the climatic conditions of the region;

 

     35-2) sports ethics – rules of conduct established for athletes, coaches, trainers, teachers and sports referees;

 

     36) full–time national teams of the Republic of Kazakhstan (full-time national sports teams) - teams of athletes, coaches, domestic and foreign specialists engaged in sports activities on financial terms provided for by the budget legislation of the Republic of Kazakhstan and participating in international sports competitions under the National Flag of the Republic of Kazakhstan;

 

     37) the head coach of the national team of the Republic of Kazakhstan by sport (national team by sport) is the coach responsible for the management, preparation, formation and performance of the national team of the Republic of Kazakhstan by sport (national team by sport) in the world Championships, Olympic, Paralympic, Deaflympic Games and other international competitions;

 

     38) the register of sports is an information system containing information recorded on paper and electronic media about sports and sports disciplines that have developed in the territory of the Republic of Kazakhstan;

 

     39) a sport is an integral part of a sport, the distinguishing features of which are the study environment, a set of physical exercises or intellectual abilities in competitive activities and the rules of competition.;

 

     40) prohibited substances and (or) methods in sports (hereinafter referred to as doping) – chemical compounds (substances, drugs) and methods included in the prohibited list of the World Anti–Doping Organization and the International Standard of the World Anti-Doping Organization, including the use or attempt to use the substance and (or) method included in the lists of substances and (or) methods prohibited for use in sports;

     40-1) mass sports events – events aimed at developing a person's physical and intellectual abilities, promoting a healthy lifestyle, held in sports facilities and facilities, as well as open areas intended for mass sports events, involving the simultaneous presence of two hundred or more spectators at these events.;

     41) the unified calendar of mass sports events is a list of annual competitions at the international, national and local levels, as well as events to prepare for the competition.;

     41-1) venues for mass sports events - facilities and structures adapted for mass sports events, as well as other places not specifically designed for these purposes (recreation areas, racetracks, circuses, parks, squares, squares, streets);

     41-2) time of mass sports events - the time from the moment of entry (arrival) of the first spectator to the venues of mass sports events until the end of the events and the exit (departure) of the last spectator from these places;

     41-3) the organizer of a mass sports event is an individual or a legal entity on whose initiative the mass sports event is being held;

 

     42) sports competition – a competition among athletes or teams in the type(s) of sports in order to identify the best participant in the competition, conducted according to the approved regulations (regulations);

     42-1) disqualification of animals participating in a sports competition – the suspension of animals from participating in sports competitions, training camps for the use of doping against them;

     43) sports activity agreement – a civil law agreement concluded between an athlete, coach or other specialist in the field of physical culture and sports and a sports organization;

 

     44) sports event – a sports competition, training camp with the participation of athletes, coaches and specialists in the field of physical culture and sports;

 

     44-1) priority sports – sports determined by the results of the ranking of sports as priority for state financing for the development of sports in the Republic of Kazakhstan;

     45) a sports federation is a non–profit organization established in the form of a public association or an association of legal entities in the form of an association (union) for the development of one or more sports;

     46) accreditation of sports federations is a procedure for recognizing the powers of sports federations to develop a type(s) of sport in the territory of the Republic of Kazakhstan;

 

     47) athlete – an individual who systematically engages in a type(s) of sport and participates in sports competitions;

 

     48) disqualification of an athlete – suspension of an athlete from participating in sports competitions and (or) training camps, and (or) labor (professional) activities in the field of physical culture and sports, which is carried out by an accredited sports federation for violating the rules of sports and (or) for violating the regulations (regulations) of sports competitions, and (or) for violation of anti-doping rules, and (or) for violation of sports ethics, and (or) for violation of norms approved by international sports organizations and (or) republican (regional) accredited sports federations;

     49) registration of an athlete is a procedure for a sports federation to recognize an athlete's affiliation to a given sport in order to grant him the right to participate in sports competitions and other events held by the federation or with its participation, with the issuance of an athlete registration certificate.;

     50) student sports is a part of physical education and sports aimed at the physical education of students in organizations of technical and vocational, post–secondary and higher education, their preparation for participation in sports events;

     51) student sports league is a sports movement among students, the purpose of which is to promote the popularization of student sports and the development of the type(s) of sports, the organization and holding of sports events with students;

     52) The Deaflympic Games are international winter and summer competitions held among athletes with hearing disabilities;

     52-1) Deaflympic sport is a sport included in the program of the Deaflympic Games and approved by the International Committee for Deaf Sports;

     53) classifier – an individual who carries out the classification of athletes with disabilities according to the level of their functional capabilities, authorized to do so by the organizers of the competition and has received special training, confirmed by the relevant document.;

     54) technical and applied sports are a part of sports that require special preparation of an athlete for competitions using technical means.;

     55) national sports – sports that have historically developed in the form of competitive activities and represent peculiar physical exercises and folk games with distinctive rules and methods of organizing physical activity.;

The Law of the Republic of Kazakhstan dated July 3, 2014 No. 228-V SAM.

     This Law regulates public relations in the field of physical culture and sports, defines the legal, organizational, economic and social foundations for ensuring the activities and development of mass physical culture, amateur and professional sports in the Republic of Kazakhstan.
