Article 50-5. Organization of electronic voting of the Constitutional Law on Elections in the Republic of Kazakhstan
1. The Chairman of the election commission, thirty minutes before the start of voting, in the presence of the commission members:
checks the functioning of the electronic election system;
determines the members of the commission responsible for the registration of voters and the issuance of electronic voting devices.
Authorized persons, observers and representatives of the mass media may be present at the polling station when checking the operation of the electronic election system.
It is prohibited for anyone to carry out actions with the electronic electoral system, except for the cases provided for in this chapter.
2. Before voting begins, the Chairman of the election commission opens the sealed password for launching the electronic election system and launches the electronic election system by entering it. At the same time, those present must first be provided with the opportunity to verify the integrity of password protection measures.
The electronic election system is launched at the time set by the Central Election Commission.
3. A voter is allowed to vote electronically on the basis of the voter lists upon presentation of a document certifying the identity of the voter.
4. When voting outside the voting premises, in accordance with this Constitutional Law, voters vote using a portable voting device, which must be equipped with the ability to save data on the votes of all voters outside the voting premises.
On the basis of applications submitted by voters in accordance with paragraph 6 of Article 41 of this Constitutional Law, information about them from the list of voters is entered into a portable electronic voting device in advance.
5. Electronic voting is carried out by a voter in a booth for secret voting, in which the presence of persons other than the voter is prohibited, except for the cases provided for in paragraph 1 of Article 42 of this Constitutional Law.
The voter finds the name of the candidate he wants to vote for or the line "Against all" on the electronic ballot paper by using the controls of the electronic voting device and confirms his vote.
When voting for political parties, a voter uses the controls of an electronic voting device to find the name of the political party he wants to vote for or the line "Against all" and confirms his vote.
The voter who voted in the voting booth hands over the electronic voting device to a member of the election commission.
6. In case of technical problems that prevent electronic voting and vote counting, the election commission has the right to make a decision on restarting the program, which is formalized by the protocol and signed by the members of the election commission.
The execution of this decision is entrusted to the specialist responsible for the operation of the electronic election system.
7. If the technical condition of the equipment does not allow for the proper conduct of elections, voting at the relevant polling station is postponed by a decision of the Central or relevant Territorial Election Commission for the period necessary for troubleshooting and organizing voting.
The voters who voted at the relevant polling station before the problems occurred, participate in the subsequent voting on a general basis.
