Article 50. Responsibility for violation of the legislation of the Republic of Kazakhstan on elections and the Constitutional Law on Elections in the Republic of Kazakhstan
1. A person shall bear criminal liability established by law in the following cases::
1) interference in the work of election commissions;
2) obstruction of voting;
3) obstructing the performance of duties related to the registration of candidates and party lists;
4) obstructing the performance of duties related to the counting of votes and the determination of election results;
5) using the advantage of one's official or official position for the purpose of electing a candidate, political party;
6) forgery of election documents;
7) deliberately incorrect vote counting;
8) deliberately incorrect determination of election results;
9) violations of the secrecy of voting;
10) hindering the free exercise by a citizen of the Republic of his right to vote through violence, deception, threats, and bribery.
2. A person shall bear administrative and other responsibilities established by the laws of the Republic of Kazakhstan in the following cases::
1) failure to provide or publish information in accordance with the requirements of this Constitutional Law;
2) failure to comply with the decision of the election commission taken within its authority;
3) conducting election campaigning before the deadline for registration of a candidate, a party list nominated by a political party, on election day or the day preceding it;
4) obstruction of the right to conduct election campaigning;
5) spreading deliberately false information about candidates, political parties, or committing other acts discrediting their honor and dignity;
6) violations of the rights of members of election commissions;
7) violations of the right of citizens to get acquainted with the list of voters;
8) providing incorrect information about voters in order to compile voter lists;
9) issuing ballots to citizens for the purpose of voting for other persons;
10) failure to provide leave to participate in elections;
11) violations of the conditions for conducting election campaigning through the media, as well as online platforms;
12) production or distribution of anonymous propaganda materials;
13) intentional destruction or damage of campaign materials;
14) providing financial (material) support to candidates, political parties that have put forward party lists, in addition to their electoral funds;
15) accepting donations from foreign states, organizations, citizens, and stateless persons for the election of a candidate;
16) violations of the conditions for conducting an election-related public opinion poll;
17) obstructing the legitimate activities of proxies of candidates, political parties, media representatives and election observers.
3. If violations of this Constitutional Law are detected, the election commission has the right to apply to the court or the prosecutor's office.
4. If a candidate or a political party violates the requirements of this Constitutional Law, with the exception of those that are grounds for refusal or cancellation of registration of a candidate, they are warned, and in case of repeated violation, the decision on registration of a candidate or party list is canceled by the relevant election commission.
