1. The right of road users to safe driving conditions on public roads is guaranteed by the State and is ensured by the implementation of this Law, compliance with legislative and regulatory acts of the Republic of Kazakhstan in this area and international treaties ratified by the Republic of Kazakhstan.

2. The exercise of the rights of some road users should not violate the rights of other road users.

3. Road users have the right to:

1) safe and convenient conditions for traffic on roads, compensation for damage caused to them as a result of non-compliance of roads, streets, squares and railway crossings with traffic safety requirements;

2) obtaining reliable information from government agencies and authorized officials about traffic conditions, the reasons for changing directions, the introduction of temporary prohibitions or restrictions on traffic on roads, the quality of products, works and services, and the rights, duties and responsibilities of officials in the field of traffic;

3) receiving a guaranteed amount of free medical care, rescue operations and other necessary assistance in case of a traffic accident from organizations and officials whose activities are related to ensuring road safety;

4) appeal, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, actions (inaction) of state bodies and their officials engaged in state regulation, management and control in the field of traffic;

5) compensation for damage in accordance with the procedure established by the insurance or civil legislation of the Republic of Kazakhstan in cases of bodily injury, as well as in cases of damage to a vehicle and (or) cargo or other material damage as a result of a traffic accident.

Road users have other rights in the field of traffic provided for by the laws of the Republic of Kazakhstan.

4. Road users are required to:

1) know and follow the rules of the road, the requirements of this Law;

2) comply with the requirements of traffic controller and traffic light signals, road signs, road markings that are used to regulate traffic, sound and light signals used during road work, special light and sound signals of vehicles of operational and special services;

3) to create safe conditions for traffic, by their actions or inaction not to cause harm to other road users, their vehicles and other property;

4) do not damage or pollute the road surface, do not remove road signs, do not obscure or damage them, do not install unauthorized road signs, traffic lights and other technical means of traffic management;

5) not to obstruct traffic or endanger its safety by throwing, unloading or leaving objects or materials on the road that interfere with traffic, to refrain from any actions that may interfere with traffic, pose a danger to people or cause damage to property;

6) take measures in case of detection or creation of an obstacle to traffic on the road to eliminate this obstacle, and if this is not possible, designate this obstacle in accordance with the requirements of this Law or in any other way ensuring road safety, and report the obstacle to the authorized body or road owners.;

7) act in good faith, correctly, be attentive and mutually polite, do not create obstacles and danger to traffic;

8) avoid polluting roads, including not throwing away garbage, objects that pose a danger to traffic, and other objects outside specially designated areas;

9) perform other duties in the field of traffic established by the laws of the Republic of Kazakhstan.

5. Road users are prohibited from:

1) to carry out vehicle repairs and maintenance on the carriageway, except in cases established by the legislation of the Republic of Kazakhstan;

2) create an obstacle to traffic or a danger to traffic;

3) damage roads and technical means of traffic regulation;

4) allow environmental pollution.

This Law establishes the legal basis and general conditions for the functioning of road traffic and ensuring its safety in the Republic of Kazakhstan.
