Article 54. Compensation in case of injury (injury, injury, contusion, occupational disease) or death (death) of a judge of the Constitutional Law on the Judicial System and the Status of Judges of the Republic of Kazakhstan

     1. If a judge receives an injury (injury, injury, contusion, occupational disease) during the performance of his official duties, he shall be paid a one-time compensation in the amount established by this article.

     2. In the event of the death (death) of a judge in the performance of official duties or within a year after the termination of the judge's powers as a result of injury (injury, injury, contusion, occupational disease) sustained in the performance of official duties, persons entitled to compensation are paid a one-time compensation in the amount of sixty months salary for the last position held.

     3. If a judge is found to be disabled as a result of an injury (injury, injury, contusion, occupational disease) sustained in the performance of his official duties, he is paid a one-time compensation in the amount of:

     1) a person with a disability of the first group - a thirty-month salary;

     2) a person with a disability of the second group - an eighteen-month salary;

     3) a person with a disability of the third group - a six-month salary.

     4. If a judge receives a serious injury (injury, injury, contusion, occupational disease) in the performance of his official duties, which did not result in disability, he is paid a one-time compensation in the amount of one and a half months official salary, and a minor injury - half a month official salary.

     5. The procedure for payment of lump-sum compensation is determined by the Government of the Republic of Kazakhstan.

     6. One-time compensation shall not be paid if, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, it is proved that the injury (injury, injury, concussion, occupational disease) or death (death) of a judge occurred due to circumstances unrelated to the performance of official duties.
