Article 6-1. Grants The Law on the State social order, the State order for the implementation of strategic partnership, grants and awards for non-governmental organizations in the Republic of Kazakhstan

Article 6-1. Grants The Law on the State social order, the State order for the implementation of strategic partnership, grants and awards for non-governmental organizations in the Republic of Kazakhstan

      1. Grants are divided into:  

      1) state grants provided at the expense of budgetary funds;    

      2) non-governmental grants provided from extra-budgetary sources of financing.  

     2. Government grants are divided into the following types::

     1) short–term grants - grants whose implementation period is from three months to one year, the amount of funding is not less than five hundred times and not more than three thousand times the monthly calculation index established by the law on the republican budget for the relevant financial year;

     2) medium–term grants – grants whose implementation period is from one to two years, the amount of funding is not less than three thousand times and not more than ten thousand times the monthly calculation index established by the law on the republican budget for the relevant financial year.;

     3) long–term grants – grants, the duration of which is from two to three years, the amount of funding is not less than ten thousand times the monthly calculation index established by the law on the republican budget for the relevant financial year, provided to non-governmental organizations that have the necessary material base for the implementation of long-term projects, in accordance with the rules of formation, provision, monitoring and evaluation of the effectiveness of government grants.

     3. State grants are provided through the operator in accordance with the contract for the provision of a state grant for the implementation of social programs and social projects developed by non-governmental organizations.

     4. State grants are provided on the basis of competitive selection to non-governmental organizations included in the Database of Non-Governmental Organizations, with the exception of non-governmental organizations:

     in the process of liquidation;

     declared bankrupt;

     having arrears in enforcement proceedings;

     members of the register of unscrupulous participants in public procurement;

     whose property has been seized;

     whose economic activity has been suspended;

     managers whose founders are the spouse, close relatives, and relatives of authorized persons of the state body and (or) the operator;

     the heads whose founders are included in the list of persons involved in terrorist activities, as well as the list of organizations and persons associated with the financing of proliferation of weapons of mass destruction, and (or) the list of organizations and persons associated with the financing of terrorism and extremism.

     5. Non-governmental organizations that have received a state grant may use part of the funds received for logistical support and institutional development.:

     1) no more than ten percent for short- and medium-term grants;

     2) no more than five percent for long-term grants.

     6. The requirements for the provision of non-governmental grants and reporting are determined by the terms of the agreement concluded between the operator and individuals or legal entities in accordance with the civil legislation of the Republic of Kazakhstan.

     7. The formation of state grants in terms of areas and amounts of financing for the next financial year, and the conduct by the operator of a competitive selection for a state grant by non-governmental organizations are carried out taking into account the results of an assessment of the effectiveness of state grants conducted by government agencies in accordance with the rules for the formation, provision, monitoring and evaluation of the effectiveness of state grants.

  This Law regulates public relations arising in the process of implementing a state social order, a state order for the implementation of a strategic partnership, the provision of grants and awards to non-governmental organizations in the Republic of Kazakhstan.
