Article 6. Competence of local executive bodies of regions, cities of republican significance, the capital, districts, cities of regional significance The Law on Equity Participation in Housing Construction

Local executive bodies of Regions, Cities of Republican significance, the capital, districts, cities of regional significance in the field of equity participation in housing construction:

1) carries out state regulation of the activities of participants in the construction of objects of shared participation in housing construction in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities;

2) allows raising money from shareholders;

3) keeps records of permits issued to raise money of shareholders;

4) on a quarterly basis, no later than the 15th day of the month following the reporting period, provide the authorized body with information on permits issued to raise money from shareholders;

5) request materials and documents from developers, authorized companies, engineering companies and a single operator necessary for monitoring the progress of construction of objects of shared participation in housing construction;

6) exercise state control and supervision in the field of equity participation in housing construction;

7) carries out interaction and cooperation with state bodies on issues related to their competence;

8) interacts with participants in equity participation in housing construction;

9) keeps records of contracts on shared participation in housing construction and contracts on shared participation in housing construction as part of the renovation, as well as contracts on the transfer of rights of claim under them;

9-1) forms and maintains a register of unscrupulous developers;

10) exercise in the interests of local public administration other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated April 7, 2016 No. 486-V SAM.

This Law regulates public relations related to the activities of equity participation in the housing construction of apartment buildings by attracting money from individuals and (or) legal entities, and also establishes guarantees for the protection of the rights and legitimate interests of the parties to the agreement on equity participation in housing construction.
