1. Authorized body:

1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

1-1) formulates and implements the state policy in the field of seed production;

1-2) carries out coordination and methodological guidance of local executive bodies in the field of seed production;

2) develops and implements scientific and technical programs for breeding, variety testing and seed production;

3) excluded by the Law of the Republic of Kazakhstan dated 13.06.2013 No. 102-V (effective after ten calendar days after its first official publication).

4) excluded by the Law of the Republic of Kazakhstan dated 04.12.2015 No. 435-V (effective from 01.01.2016);

5) predicts the volume of production and sale of seeds of agricultural plant varieties recommended for use in the Republic of Kazakhstan;

6) develops and approves the rules for the certification of producers of original and elite seeds, seeds of the first, second and third reproductions, seed sellers;

7) excluded by the Law of the Republic of Kazakhstan dated 10.01.2006 No. 116 (for the procedure of entry into force, see art. 2 of the Law No. 116);

7-1) develops and approves lists of genera and species of plants for which patentability and economic usefulness are assessed according to the data of the state test or the applicant;

7-2) approves:

the procedure for maintaining the State Register of Breeding achievements recommended for use in the Republic of Kazakhstan;

regulations on the Republican Commission on variety testing of agricultural plants;

methods of conducting variety testing of agricultural plants;

the procedure for setting annual quotas for the production of original and sale of subsidized elite seeds for certified seed production entities;

the procedure for testing varietal crops;

8) excluded by the Law of the Republic of Kazakhstan dated 13.06.2013 No. 102-V (effective after ten calendar days after its first official publication).

8-1) develops and approves rules for the implementation of varietal and seed control, soil assessment, laboratory varietal tests, and seed quality expertise;

8-2) determines the directions of state support for seed production, the list of agricultural plants, the seeds of which are subject to subsidization at the expense of budgetary funds, and the standards of subsidies for them.;

8-3) develops and approves rules for subsidizing the development of seed production;

8-4) develops and approves the rules for conducting variety testing of agricultural plants;

8-5) is excluded by the Law of the Republic of Kazakhstan dated 04.12.2015 No. 435-V (effective from 01.01.2016);

8-6) develops and approves the rules for the examination of varietal and sowing qualities of seeds, including seeds intended for sowing by domestic agricultural producers;

9) excluded by the Law of the Republic of Kazakhstan dated 13.06.2013 No. 102-V (effective after ten calendar days after its first official publication).

11) develops and approves regulatory legal acts on variety testing and seed production and forms of documentation for seeds;

11-1) excluded by the Law of the Republic of Kazakhstan dated 11/27/2015 No. 424-V (effective six months after the date of its first official publication);

12) considers draft standardization documents within the scope of its competence, and also makes proposals for the development, amendment, revision and cancellation of national, interstate standards, national classifiers of technical and economic information and recommendations on standardization to the authorized body in the field of standardization;

13) excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 36-V (effective after ten calendar days after its first official publication);

13-1) coordinates the reduction of seed quality indicators for a period of no more than one year, established by national standards and other documents on standardization in the field of seed production, based on appeals from local executive bodies of regions, cities of republican significance and the capital in unfavorable weather and climatic conditions years.;

14) develops and approves schemes and methods of primary, elite and industrial (mass) seed production;

15) organizes state tests of varieties of domestic and foreign breeding;

16) registers originators of varieties in accordance with the rules for registration of originators of varieties approved by the authorized body;

18) monitors the seed resources of the Republic;

19) carries out, within its competence, international cooperation in breeding and seed production;

21) approves the State Register of Breeding achievements recommended for use in the Republic of Kazakhstan and the list of promising varieties of agricultural plants;

22) excluded by the Law of the Republic of Kazakhstan dated 13.06.2013 No. 102-V (effective after ten calendar days after its first official publication).

26) requests the necessary information in the field of seed production of agricultural plants from local executive bodies;

27) draws up the balance of seeds for the republic;

29) establishes the forms of description of the variety with an opinion on the grant of a patent, an opinion on the patentability of the variety;

30) excluded by the Law of the Republic of Kazakhstan dated 09/29/2014 No. 239-V (effective ten calendar days after the date of its first official publication);

31) approves the forms of an order to eliminate violations of the requirements of the legislation of the Republic of Kazakhstan on seed production, a protocol on an administrative offense, and a resolution on an administrative offense case;

31-1) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);

31-2) sets prices for goods (works, services) produced and/or sold by government agencies in the field of variety testing;

32) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

2. The authorized body carries out its activities through territorial bodies.

The Law of the Republic of Kazakhstan dated February 8, 2003 No. 385.

This Law defines the legal, economic and organizational bases for carrying out activities in the field of seed production and is aimed at regulating the organization and functioning of the seed production system and state control over the production, harvesting, processing, storage, transportation, sale and use of seeds of agricultural plants.
