1. A mortgage agreement is concluded in writing, signed by the mortgagor and the mortgagee, as well as by the debtor, if the mortgagor is not a debtor (a real surety).

2. The mortgage agreement is the basis for mortgage registration. The right of mortgage arises from the moment of its registration.

3. Notarization of the mortgage agreement is carried out at the request of the parties.

4. The rights of the mortgagee may be confirmed (formalized) by issuing a mortgage certificate.
