Article 6. Management of the condominium facility and maintenance of the common property of the condominium facility of the Law on Housing Relations - Excluded by the Law of the Republic of Kazakhstan dated July 15, 2025 No. 207-VIII SAM

The owners of apartments and non-residential premises manage the condominium facility and the maintenance of the common property of the condominium facility by participating in a meeting, choosing the form of management of the condominium facility, electing the house council, as well as paying the costs of managing the condominium facility and maintaining the common property of the condominium facility.

Services for the maintenance of the common property of a condominium facility are provided by a service business entity on the basis of an agreement concluded with the chairman of the association of property owners or a trustee of a simple partnership or the manager of an apartment building or a management company or a temporary management company.

Losses caused to the owners of apartments, non-residential premises, parking spaces, storerooms by individuals and legal entities performing the functions of managing the condominium facility and maintaining the common property of the condominium facility are subject to compensation in accordance with the civil legislation of the Republic of Kazakhstan.

It is not allowed to provide services for the maintenance of the common property of a condominium facility by concluding an individual agreement between the owners of apartments, non-residential premises and a service provider, unless otherwise provided by this Law.
