Article 6. Objects of architectural, urban planning and construction activities of special regulation and urban planning regulation of the Law on Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan

Article 6. Objects of architectural, urban planning and construction activities of special regulation and urban planning regulation of the Law on Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan

     1. The objects of architectural, urban planning and construction activities of special regulation and urban planning regulations are divided into:  

     1) territorial objects of special regulation and urban planning regulation;  

      2) settlements of special regulation and urban planning regulations;  

     3) individual real estate objects that require special regulation and (or) urban planning regulations;

     4) individual construction projects that require special regulation and (or) urban planning regulations.

     2. The territorial objects of architectural, urban planning and construction activities of special regulation and urban planning regulations include:  

     1) zones of ecological disaster and (or) emergency situations;  

      2) specially protected natural areas;  

      3) water protection zones and strips;  

      4) territories with objects of historical and cultural heritage and (or) protected unique and rare landscapes;  

      5) territories of health, resort, recreational and reserve purposes;  

     6) Suburban areas;

     6-1) agglomeration territories;

      7) zones of restricted territories and other territories classified by legislative acts of the Republic of Kazakhstan as zones of special regulation.  

     3. Localities with special regulation of architectural, urban planning and construction activities and urban planning regulations include:  

     1) the capital of the Republic of Kazakhstan and cities of national importance;  

      2) cities with a population of over one hundred thousand inhabitants;  

      3) resort towns and villages;  

      4) settlements, their parts or the territory adjacent to them, having historical, cultural value, or protected landscape objects, as well as settlements in nature reserves and national parks;  

      5) military camps, border posts and settlements in other closed facilities;  

      6) settlements located in areas with special (extreme) climatic, geotechnical or hydrogeological conditions, as well as in areas of environmental and man-made disasters or affected by other adverse phenomena and processes.  

     4. Real estate objects with special regulation of architectural, urban planning and construction activities and urban planning regulations include:  

     1) historical and cultural monuments and their ensembles;  

      2) objects of the state nature reserve fund;  

      3) structures necessary for the performance of special state or economic tasks, including facilities that are known to pose a danger to human life and health or the environment.;  

     4) buildings and structures for the residence, stay and work of persons with disabilities.

     4-1. Individual construction projects that require special regulation and/or urban planning regulations are determined by the authorized body for architecture, urban planning and construction.

     5. The regime of special regulation is established by this Law and other legislative acts of the Republic of Kazakhstan.  

 

 

The Law of the Republic of Kazakhstan dated July 16, 2001 No. 242.

This Law regulates the relations that arise between government agencies, individuals and legal entities in the process of carrying out architectural, urban planning and construction activities in the Republic of Kazakhstan, and is aimed at creating a full-fledged human habitat and vital activity, sustainable development of settlements and interuniverse territories.
