Article 6. Procedure for the application of the legislation of the Republic of Kazakhstan on enforcement proceedings and the status of bailiffs The Law on Enforcement Proceedings and the Status of Bailiffs

     1. Enforcement proceedings are carried out in accordance with the rules in force at the time of the execution of enforcement actions.

     2. Enforcement proceedings to collect arrears of tax and other mandatory payments to the budget, penalties for late payment of fines and other sanctions for violation of the tax legislation of the Republic of Kazakhstan are carried out in accordance with the procedure established by this Law and in accordance with the tax and customs legislation of the Republic of Kazakhstan.

     3. Enforcement proceedings to recover from the state the amounts of capitalization of the relevant time-based payments for compensation for damage caused to the life and health of employees, in the event of absence or insufficiency of property from the liquidated legal entity, recognized in accordance with the established procedure responsible for this damage, shall be carried out in accordance with this Law in compliance with the rules established by the authorized body.

     3-1. Execution of judicial acts at the expense of the state budget for compensation for damage caused as a result of unlawful conviction, unlawful prosecution, unlawful use of detention as a preventive measure, house arrest, non-departure, unlawful imposition of administrative penalties in the form of arrest or correctional labor, illegal placement in an organization providing medical care in in the field of mental health, or another medical organization, conducting secret investigative actions, subsequently recognized as illegal in court, it is carried out in accordance with the procedure established by the central authorized body for budget execution.

     4. The execution of acts of courts and other bodies in respect of foreigners, stateless persons and foreign organizations shall be carried out in accordance with this Law.

     5. Enforcement proceedings on enforcement documents of other States in the territory of the Republic of Kazakhstan are carried out in accordance with the legislation of the Republic of Kazakhstan, unless otherwise provided for by international treaties ratified by the Republic of Kazakhstan.
