Article 6. Types of aviation The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities

     1. The aviation of the Republic of Kazakhstan is divided into state, civil and experimental.

     2. State aviation is aviation that is under the jurisdiction of the authorized body in the field of state aviation, internal affairs and national security bodies of the Republic of Kazakhstan, as well as other state bodies by decision of the Government of the Republic of Kazakhstan and is used for defense, state security, public order protection, as well as the provision of airport services.

     3. Civil aviation is recognized as aviation that is not part of experimental and state aviation, used for the purposes of:

     1) transportation of passengers, baggage, cargo and mail (air transportation);

     2) performing aviation work;

     3) conducting educational, sports, cultural and educational events, and developing technical creativity;

     4) meeting the personal needs of the aircraft operator;

     5) conducting search and rescue and emergency rescue operations, providing assistance in case of natural disasters;

     6) provision of air navigation services;

     7) aircraft maintenance and repair;

     8) carrying out airport activities and (or) airfield (heliport) services;

     9) designing airfields and civil aviation facilities.

     Civil aviation used for the purposes specified in subitems 1), 2) and 5) of this paragraph, for a fee or for hire, is recognized as commercial aviation.

     Civil aviation owned by individuals and (or) legal entities and used for the purposes specified in subitems 1), 2) and 5) of this paragraph, not for pay or for hire, as well as for the purposes specified in subitems 3) and 4) of this paragraph, is recognized as general aviation.

     Civil aviation using aircraft with a maximum certified take-off weight of less than five thousand seven hundred kilograms, including helicopters with a maximum certified take-off weight of less than three thousand one hundred seventy-five kilograms, is recognized as light aviation.

     Civil aviation using aircraft with a maximum certified take-off weight of less than seven hundred and fifty kilograms, other aircraft and auxiliary devices is recognized as ultralight aviation.

     4. Experimental aviation is recognized as aviation intended for carrying out development, experimental, scientific research and testing in the field of aviation and other equipment.

 

 

The Law of the Republic of Kazakhstan dated July 15, 2010 No. 339-IV.

     This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
