Article 61. Body of inquiry CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. The bodies of inquiry, depending on the nature of the criminal offense, are charged with:
1) taking the necessary criminal procedural and investigative measures in accordance with the competence established by law in order to detect signs of criminal offenses and the persons who committed them, to prevent and suppress criminal offenses;
2) carrying out criminal procedural and investigative measures in accordance with the procedure provided for in Article 196 of this Code in cases where a preliminary investigation is being conducted;
3) an inquiry in cases in which a preliminary investigation is not necessary, in accordance with the procedure provided for in Article 191 of this Code.;
4) the implementation of an expedited pre-trial investigation established by Article 190 of this Code;
5) conducting a pre-trial investigation in a protocol form on criminal offenses;
6) conducting a preliminary investigation in the cases provided for in parts three and five of Article 189 of this Code.
7) conducting a parallel financial investigation. IZPI's note! Part 1 is provided to be supplemented by paragraph 7) in accordance with the Law of the Republic of Kazakhstan dated 07/16/2025 No. 210-VIII (effective from 01/01/2027).
2. The bodies of inquiry are:
1) internal affairs bodies;
2) National security agencies;
3) Anti-corruption service;
3-1) Economic Investigation Service;
4) excluded by the Law of the Republic of Kazakhstan dated 07.11.2014 No. 248-V (effective from 01.01.2015);
5) military police bodies – in cases of all criminal offenses committed by military personnel, civilian personnel of military units, formations, institutions in connection with the performance of their official duties or in the location of these units, formations and institutions;
The military police bodies of the National Security Committee are also responsible for all criminal offenses committed by military personnel and employees of special government agencies.;
military police bodies of the Armed Forces – also in cases of all criminal offenses committed by military personnel of the governing bodies and military units of the civil defense of the authorized body in the field of civil protection;
6) border guard agencies – in cases of violation of the legislation on the State Border of the Republic of Kazakhstan, as well as criminal offenses committed on the continental shelf of the Republic of Kazakhstan;
7) commanders of military units, formations, heads of military institutions and garrisons, in the absence of a military police body, in cases of all criminal offenses committed by military personnel subordinate to them, in cases of criminal offenses committed by civilian personnel of military units, formations, institutions in connection with the performance of their official duties or in the location of these units, formations, and institutions;
8) heads of diplomatic missions, consular offices and authorized missions of the Republic of Kazakhstan – in cases of criminal offenses committed by their employees in the host country;
9) The State Security Service of the Republic of Kazakhstan – in cases of criminal offenses committed in the area of security measures and directly directed against protected persons, the list of which is established by law;
10) excluded by the Law of the Republic of Kazakhstan dated 07.11.2014 No. 248-V (effective from 01.01.2015).
11) bodies of the state fire service – in cases of criminal offenses related to fires.
3. The rights and obligations of the body of inquiry for pre-trial proceedings and the performance of urgent investigative actions in cases of all criminal offenses are also assigned to the captains of sea vessels on long voyages, heads of geological exploration parties, other government organizations and their divisions remote from the bodies of inquiry listed in the second part of this article – during the absence of transport links.
