Article 69. Appointment of elections of deputies of the Senate of the Constitutional Law on Elections in the Republic of Kazakhstan
1. Grounds for appointment:
1) regular elections are the end of the constitutional term of office of the deputies of the Senate;
2) early elections - the early termination of the powers of Parliament; the formation of appropriate administrative-territorial units that do not have representation in the Senate;
3) election of deputies instead of those who have retired - early termination of the deputy's powers, deprivation of his mandate or his death.
2. Election of deputies in the case provided for in subparagraph 1) 1 of this Article, are appointed by the President of the Republic at least four months before the end of the constitutional term of office of the deputies of the Senate and are held at least two months before the end of the constitutional term of office.
3. In the event of early termination of the powers of Parliament, elections of deputies shall be appointed by the President of the Republic simultaneously with his decision on early termination of the powers of Parliament and shall be held within two months from the date of early termination of the powers of Parliament.
The date of commencement of the period during which early elections of deputies are to be held is the date of the enactment of the act of the President of the Republic on the dissolution of Parliament. This period ends at the end of two months. If the deadline falls on a month that does not have a corresponding date, the deadline expires on the last day of that month.
Elections of deputies in the case of the formation of a corresponding administrative-territorial unit that does not have representation in the Senate of Parliament are appointed by the President no later than three months from the date of the formation of the administrative-territorial unit and are held within two months from the date of the election.
4. In the cases provided for in subparagraph 3) According to paragraph 1 of this article, the election of deputies to replace those who have retired shall be appointed by the Central Election Commission no later than two months after the date of early termination, deprivation of the deputy's mandate or his death.
5. Elections of deputies of the Senate are appointed subject to the requirements of paragraph 3 of Article 41 of the Constitution and may not coincide in time with the elections of deputies of the Mazhilis of Parliament.
