Article 7. Application of standards and recommended practices of the International Civil Aviation Organization (ICAO), as well as aviation regulations of other international organizations in the field of civil aviation The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities

1. The application of standards and recommended practices of the International Civil Aviation Organization (ICAO) in the territory of the Republic of Kazakhstan is carried out by adopting relevant regulatory legal acts provided for by the legislation of the Republic of Kazakhstan on the use of the airspace of the Republic of Kazakhstan and aviation activities, making necessary amendments and additions to them, or specifying references to the application of specific standards and recommended practices of the International Organization Civil Aviation (ICAO).

1-1. In the airspace over which sovereignty is not defined, where the Republic of Kazakhstan is responsible for providing air traffic services, the standards and recommended practices of the International Civil Aviation Organization (ICAO) are applied in accordance with the procedure defined by the legislation of the Republic of Kazakhstan.

2. Aviation rules of international organizations in the field of civil aviation may be applied on the territory of the Republic of Kazakhstan, if they do not contradict the legislation of the Republic of Kazakhstan on the use of the airspace of the Republic of Kazakhstan and aviation activities, and the requirements provided for in these aviation rules may not be lower than the requirements set out in the standards of the International Civil Aviation Organization (ICAO).

Certain requirements contained in the aviation regulations of international organizations in the field of civil aviation may be included in the legislation of the Republic of Kazakhstan on the use of the airspace of the Republic of Kazakhstan and aviation activities.

The operator of a civil aviation aircraft, the type of which is certified by the aviation authorities of a foreign state, has the right to apply the aviation rules of international organizations in the field of civil aviation in English.

3. Aviation standards of international organizations in the field of civil aviation do not relate to standardization documents, which are regulated in accordance with the legislation of the Republic of Kazakhstan in the field of standardization.

The Law of the Republic of Kazakhstan dated July 15, 2010 No. 339-IV.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
