1. The bodies carrying out counterintelligence activities include special state bodies of the Republic of Kazakhstan.

2. Special state bodies of the Republic of Kazakhstan shall carry out counterintelligence activities in accordance with the procedure established by this Law and within the limits defined by paragraphs 3, 4, 5 of this Article.

3. The national security bodies of the Republic of Kazakhstan (hereinafter referred to as the national security bodies) conduct counterintelligence activities on the grounds provided for in the subparagraphs 1), 2), 4), 5), 6), 7), 8), 9), 10) paragraph 1 of Article 10 of this Law.

National security agencies also carry out counterintelligence activities on the grounds provided for in subparagraph 3) paragraph 1 of Article 10 of this Law, in cases and in accordance with the procedure determined by a joint regulatory legal act of the national security authorities and the State Security Service of the Republic of Kazakhstan.

4. The State Security Service of the Republic of Kazakhstan (hereinafter referred to as the State Security Service) conducts counterintelligence activities on the grounds provided for in subparagraphs 3), 9), 10) of paragraph 1 of Article 10 of this Law.

5. The authorized body in the field of foreign intelligence of the Republic of Kazakhstan (hereinafter referred to as the authorized body in the field of foreign intelligence) conducts counterintelligence activities on the grounds provided for in subparagraphs 4), 9), 10) of paragraph 1 of Article 10 of this Law.

The authorized body in the field of foreign intelligence also conducts counterintelligence activities on the basis provided for in subparagraph 8) of paragraph 1 of Article 10 of this Law, in cases and in accordance with the procedure determined by a joint regulatory legal act of the authorized body in the field of foreign intelligence and national security agencies.

6. The procedure for interaction of bodies engaged in counterintelligence activities is determined by joint regulatory legal acts.

7. The first heads of bodies engaged in counterintelligence activities establish a list of subordinate departments, services, divisions, and categories of employees authorized to carry out counterintelligence activities, and issue regulatory legal acts on the organization and tactics of counterintelligence activities and the implementation of their tasks.

This Law defines the legal basis of counterintelligence activities and the system of guarantees of legality of their implementation.
