Article 7. Competence of State plant protection inspectors of the Law on Plant Protection
1. The head of the department of the authorized body is the Chief State Inspector for Plant Protection of the Republic of Kazakhstan.
The heads of the relevant territorial divisions of the department of the authorized body are the chief state plant protection inspectors of the relevant administrative-territorial units of the Republic of Kazakhstan.
Other officials of the department of the authorized body who directly carry out state phytosanitary control are state plant protection inspectors.
2. The competence of the Chief State Plant Protection Inspector of the Republic of Kazakhstan includes:
1) organization and implementation of state phytosanitary control over compliance with the requirements of the legislation of the Republic of Kazakhstan on plant protection in the territory of the Republic of Kazakhstan;
2) issuing instructions to individuals and legal entities on the elimination of identified violations of the legislation of the Republic of Kazakhstan on plant protection and monitoring their implementation;
3) organization of phytosanitary accounting and reporting;
4) sampling during the implementation of state phytosanitary control;
5) drawing up protocols on administrative offenses, consideration of cases of administrative offenses and imposition of administrative penalties;
6) exercise of other powers provided for by the legislation of the Republic of Kazakhstan.
3. The competence of the Chief State Inspector for Plant protection of the relevant administrative-territorial unit includes:
1) organization and implementation of state phytosanitary control over compliance with the requirements of the legislation of the Republic of Kazakhstan on plant protection in the relevant territory;
2) issuing instructions to individuals and legal entities on the elimination of identified violations of the legislation of the Republic of Kazakhstan on plant protection and monitoring their implementation;
3) organization, maintenance of phytosanitary records and reporting in the relevant territory and submission of a report in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
4) sampling during the implementation of state phytosanitary control;
5) drawing up protocols on administrative offenses, consideration of cases of administrative offenses and imposition of administrative penalties.
4. The competence of the State Plant Protection Inspector includes:
1) organization and implementation of state phytosanitary control over compliance with the requirements of the legislation of the Republic of Kazakhstan on plant protection in the relevant territory;
2) maintaining phytosanitary records and reporting in accordance with the established form and submitting them to the department of the authorized body;
3) sampling during the implementation of state phytosanitary control;
4) drawing up protocols on administrative offenses, consideration of cases of administrative offenses and imposition of administrative penalties;
5) issuing instructions to individuals and legal entities on the elimination of identified violations of the legislation of the Republic of Kazakhstan on plant protection and monitoring their implementation.
The Law of the Republic of Kazakhstan dated July 3, 2002 No. 331.
This Law defines the legal, economic and organizational bases for carrying out activities in the field of plant protection from pests, weeds and plant diseases and is aimed at preserving crops, their quality and preventing harmful effects on human health and the environment when implementing phytosanitary measures in the territory of the Republic of Kazakhstan.
