Article 7. Competence of the Commissioner for Human Rights in the Republic of Kazakhstan of the Constitutional Law on the Commissioner for Human Rights in the Republic of Kazakhstan

Article 7. Competence of the Commissioner for Human Rights in the Republic of Kazakhstan of the Constitutional Law on the Commissioner for Human Rights in the Republic of Kazakhstan

     The Commissioner for Human Rights in the Republic of Kazakhstan in his activities:

     1) submits proposals to the President of the Republic of Kazakhstan, the Parliament of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan on the development of draft laws, improvement of legislation of the Republic of Kazakhstan on the promotion and protection of human and civil rights and freedoms;

     2) ensures the preparation and dissemination of an annual report on its activities, as well as special reports;

     3) participates by invitation in joint and separate sessions of the Chambers of the Parliament of the Republic of Kazakhstan in accordance with the Constitutional Law of the Republic of Kazakhstan "On the Parliament of the Republic of Kazakhstan and the status of its deputies", meetings of the working bodies of the Parliament of the Republic of Kazakhstan and its Chambers and other events with the participation of deputies of the Parliament of the Republic of Kazakhstan;

     4) has the right to attend the plenary sessions of the maslikhats of regions, cities of republican significance or the capital in accordance with the laws of the Republic of Kazakhstan.;

     5) participates by invitation in meetings of the Government of the Republic of Kazakhstan, the Constitutional Court of the Republic of Kazakhstan, collegial state bodies and other bodies formed in state bodies;

     6) submits recommendations and proposals to the Government of the Republic of Kazakhstan and other state bodies, local government and self-government bodies, other organizations and officials on measures aimed at preventing violations and restoring human and civil rights and freedoms;

     7) submits proposals to the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan, deputies of the Parliament of the Republic of Kazakhstan and state bodies of the Republic of Kazakhstan in accordance with the tasks specified in this Constitutional Law;

     8) coordinates the activities of participants in the national preventive mechanism for the prevention of torture and other cruel, inhuman or degrading treatment or punishment;

     9) consider complaints about violations of human and civil rights and freedoms in accordance with the procedure established by this Constitutional Law;

     10) makes proposals on the ratification of international treaties in the field of human rights and freedoms or another way for the Republic of Kazakhstan to express its consent to be bound by an international treaty;

     11) participates, at the invitation of authorized bodies, in the preparation and discussion of national reports that are submitted to United Nations bodies and committees, as well as regional institutions in fulfillment of contractual obligations of the Republic of Kazakhstan, and expresses an independent opinion on these issues in accordance with the procedures of these bodies and committees.;

     12) cooperates with international, regional and other organizations, as well as national human rights institutions of other States, including through the conclusion of agreements (memoranda), in order to promote and protect human and civil rights and freedoms;

     13) promotes the development of educational and research programs on human and civil rights, participates in their implementation in educational organizations and other organizations;

     14) approves:

     rules for reviewing complaints;

     regulations on the Coordinating Council under the Commissioner for Human Rights in the Republic of Kazakhstan;

     regulations on the Expert Council under the Commissioner for Human Rights in the Republic of Kazakhstan;

     rules for the selection of participants of the national preventive mechanism;

     rules for the formation of groups of participants of the national preventive mechanism for preventive visits;

     guidelines for preventive visits;

     the position and description of the symbol and flag of the Commissioner for Human Rights in the Republic of Kazakhstan;

     15) appeals to the Constitutional Court of the Republic of Kazakhstan on the issue of compliance of normative legal acts affecting human and civil rights and freedoms enshrined in the Constitution of the Republic of Kazakhstan with the Constitution of the Republic of Kazakhstan;

     16) at the invitation of a foreign state, the right to act as an observer for the observance of human rights and freedoms in other states;

     17) requests from government agencies, scientific institutions and other organizations expert and analytical research on human and civil rights and freedoms, if any.;

     18) freely visits organizations and institutions providing special social services, providing temporary isolation from society or intended for the execution of punishment, subject to preventive visits;

     19) makes film, photo and video recordings, interviews, including using audio and video equipment, with the consent of persons located in relevant organizations and institutions providing special social services, providing temporary isolation from society or intended for the execution of punishment;

     20) participates in a public dialogue on the settlement of disputes between state bodies, local government and self-government bodies, other organizations and citizens of the Republic of Kazakhstan and makes recommendations, guided by the goals, objectives and principles of its activities;

     21) exercise other powers in accordance with the legislation of the Republic of Kazakhstan.

 

Constitutional Law of the Republic of Kazakhstan dated November 5, 2022 No. 154-VII SAM.

     This Constitutional Law defines the legal status and organization of the activities of the Commissioner for Human Rights in the Republic of Kazakhstan.
