1. Voluntary insurance in the field of merchant shipping is carried out by individuals and legal entities by virtue of their will. The types, conditions and procedure of voluntary insurance are determined by agreement of the parties.

2. The types subject to compulsory insurance of civil liability in the field of merchant shipping include:

1) the risk of liability of the carrier for obligations arising as a result of harm to the life, health and property of the passenger;

2) excluded by the Law of the Republic of Kazakhstan dated 12/30/2009 No. 234-IV (effective from 08/9/2010);

3) the risk of liability of the carrier when transporting dangerous goods, as well as for damage caused by marine oil pollution from ships (when transporting oil in the amount of two thousand tons or more).

4) the risk of liability of the ship's owner or shipowner for the removal of sunken property.

The conditions and procedure for compulsory insurance in the field of merchant shipping are determined by the legislative acts of the Republic of Kazakhstan.

Employees are subject to compulsory accident insurance in the performance of their labor (official) duties in accordance with the legislative act of the Republic of Kazakhstan on compulsory insurance.

The Law of the Republic of Kazakhstan dated January 17, 2002 No. 284.

This Law defines the legal, organizational, economic and international foundations of public administration in the field of merchant shipping and regulates relations related to the transportation of passengers, baggage and cargo, ensuring safety in maritime transport and environmental protection.
