Article 7. Prohibitions imposed on the turnover of civilian and service weapons and ammunition by the Law on State Control over the Turnover of Certain Types of Weapons

Article 7. Prohibitions imposed on the turnover of civilian and service weapons and ammunition by the Law on State Control over the Turnover of Certain Types of Weapons

     1. The circulation of civilian and service weapons and ammunition is prohibited on the territory of the Republic of Kazakhstan.:

     1) long-barreled firearms with a magazine (drum) capacity of more than 10 rounds, having a barrel length or a barrel length with a receiver of less than 500 millimeters and a total length of less than 800 millimeters, as well as having a design that allows its length to be less than 800 millimeters, and the possibility of firing is not lost.;

     2) civilian firearms that allow firing bursts;

     3) firearms that have a shape that mimics other objects;

     4) smoothbore firearms made for cartridges for firearms with a rifled barrel, with the exception of the "paradox system" weapon, which has no more than 40 percent of the rifled part of the barrel length.;

     5) throwing throwing weapons, impact-crushing weapons and objects specially adapted for use as impact-crushing and throwing weapons, with the exception of sports equipment, in accordance with the legislation of the Republic of Kazakhstan;

     6) knives, the blades of which are more than 90 millimeters are automatically removed from the handle when a button or lever is pressed and fixed by them or extended due to gravity or accelerated movement and fixed;

     7) cartridges with armor-piercing, incendiary, explosive or tracer bullets with an offset center of gravity, as well as cartridges with shotgun shells for gas pistols and revolvers in accordance with the legislation of the Republic of Kazakhstan;

     8) weapons and other objects, the damaging effect of which is based on the use of radioactive radiation and biological effects;

     9) gas weapons equipped with nerve agents, toxic substances, as well as other substances prohibited for use by the authorized body in the field of public health, as well as gas weapons capable of causing damage at a distance of more than one meter that is not dangerous to human life, but entailing prolonged health disorder for a period of more than twenty-one days or significant persistent disability by 10 percent or more;

     10) weapons and ammunition for them, as well as products structurally similar to weapons that have technical characteristics that do not meet forensic requirements;

     11) weapons and cartridges for them that do not meet the safety requirements established by technical regulations in the sphere of turnover of civilian and service weapons and cartridges for them;

     12) weapons and other objects, the damaging effect of which is based on the use of electromagnetic, light, thermal, infrasound or ultrasonic radiation;

     13) self-defense firearms, electric shock devices and spark arresters having output parameters exceeding the values established by national standards;

     14) weapons made of materials that do not allow their detection by metal detectors.

     2. It is forbidden:  

     1) storage or use outside sports facilities of sports firearms with a rifled barrel or sports pneumatic weapons with a muzzle energy of over 7.5 joules and a caliber of more than 4.5 mm, as well as sports cold-bladed weapons; storage and use of projectiles and throwing weapons outside sports facilities with a bowstring tension of over 14 kg without permission to store and carry them, with the exception of storage and use of bows and crossbows for scientific research and preventive work related to the immobilization and injection of wildlife;

      2) purchase by citizens of pneumatic weapons with a caliber of more than 4.5 mm;  

      3) installation of devices for silent shooting and night sights on service and civilian weapons;  

     4) mailing of weapons (their main (component) parts) and cartridges for them, including by international mail;

      5) the carrying of weapons by citizens participating in peaceful assemblies and other mass public events;  

      6) carrying weapons in an open (uncovered) form in public places;  

     6-1) transfer of weapons to another person, except for the cases provided for by this Law;

     6-2) purchase by citizens of long-barrelled rifled firearms with a caliber of more than."338 LapuaMag" (8.6*70mm);

     6-3) the use of firearms, gas, electric, pneumatic, throwing and cooling weapons (except in cases provided for by the legislation of the Republic of Kazakhstan or self-defense) in populated areas and places not designated for this purpose;

     7) carrying a weapon without a permit as an accessory to the national costume;

     8) turnover in the territory of the Republic of Kazakhstan of mass-dimensional models made of firearms;

     9) the turnover of cold-bladed weapons is more than 90 millimeters without proper registration.

 

 

The Law of the Republic of Kazakhstan dated December 30, 1998 No. 339.

      This Law regulates legal relations arising from the turnover of civilian, service, military handguns and cold steel weapons in the territory of the Republic of Kazakhstan, and is aimed at protecting the life and health of citizens, property, ensuring public safety, protecting environmental facilities, resources, and developing international cooperation in combating crime and illegal proliferation of weapons.  

      The provisions of this Law also apply to the circulation of ammunition (cartridges).
