Article 7. Rights and obligations of entities responsible for the safety of machinery and equipment The Law on the Safety of Machinery and Equipment
1. Entities responsible for the safety of machinery and equipment have the right:
1) receive timely and reliable information on the compliance of machinery and equipment with the safety requirements established by this Law and technical regulations;
2) apply to the authorized bodies with a statement on the non-compliance of machinery and equipment with the safety requirements established by this Law and technical regulations.
2. Along with the rights provided for in paragraph 1 of this Article, the manufacturer has the right:
1) participate in the development of regulatory legal acts in accordance with the legislation of the Republic of Kazakhstan;
2) develop and approve standards of the organization that meet the mandatory requirements of the legislation of the Republic of Kazakhstan in the field of safety of machinery and equipment;
3) develop production control programs for the safety of machinery and equipment;
4) implement quality and safety management systems for machinery and equipment;
5) to restore (repair) or substantially modify (modernize), distribute machines and (or) equipment.
3. The entities responsible for the safety of machinery and equipment are obliged to:
1) comply with the requirements of the legislation of the Republic of Kazakhstan in the field of safety of machinery and equipment;
2) cooperate with authorized bodies on issues of prevention or reduction of risks associated with machinery and equipment.
4. Along with the duties provided for in paragraph 3 of this Article, the manufacturer must:
1) submit documents certifying the safety of machinery and equipment to users, as well as to authorized bodies ensuring the safety of machinery and equipment, upon their request;
2) provide machines and equipment with operating instructions and other information in the state and Russian languages that comply with the requirements of the Law of the Republic of Kazakhstan "On Languages in the Republic of Kazakhstan", which are necessary for the user to assess possible risks and take appropriate safety measures.;
3) to ensure the safety control of machinery and equipment in the processes of design, production, storage and transportation, as well as in cases of repair, maintenance and service, modernization and distribution, in which he participates;
4) to verify user complaints about non-compliance of machines and equipment with the safety requirements established by this Law;
5) immediately stop the production processes of machinery and equipment if a violation has been committed that has led to their acquisition of dangerous properties, ensure their recall from buyers (users) and conduct an expert examination, and then take measures to
to eliminate violations or, if necessary, organize their disposal or destruction;
6) ensure the possibility of hazard identification of machinery and equipment at the stage of their implementation, storage, destruction and disposal;
7) to ensure timely and effective warning to the user, as well as the adoption of necessary measures, including the recall of machines and equipment in the event of their non-compliance with the safety requirements established by this Law; and
technical regulations.
5. Along with the duties provided for in paragraph 3 of this Article, the authorized representative must:
1) submit documents certifying the safety of machinery and equipment to users, as well as to authorized bodies ensuring the safety of machinery and equipment, upon their request;
2) to verify user complaints about non-compliance of machines and equipment with the safety requirements established by this Law;
3) to ensure the safety control of machinery and equipment during their sale, storage and transportation;
4) ensure the possibility of hazard identification of machinery and equipment at the stage of their implementation, storage, transportation;
5) to ensure timely and effective warning to the user, as well as the adoption of necessary measures, including the recall of machines and equipment in the event of their non-compliance with the safety requirements established by this Law; and
technical regulations, and posing a danger to human life and health, and the environment.
6. Along with the duties provided for in paragraph 3 of this Article, the importer must:
1) to verify user complaints about non-compliance of machines and equipment with the safety requirements established by this Law;
2) to ensure the safety control of machinery and equipment during their sale, storage and transportation;
3) provide an opportunity to identify the danger of machinery and equipment at the stage of their implementation, storage, transportation;
4) to ensure timely and effective warning to the user, as well as the adoption of necessary measures, including the recall of machines and equipment in the event of their non-compliance with the safety requirements established by this Law; and
technical regulations, and posing a danger to human life and health, and the environment.
7. Along with the duties provided for in paragraph 3 of this Article, personnel (operators) must:
1) promptly inform the authorized bodies of violations of the safety requirements established by this Law and technical regulations, machines and equipment put into circulation, which have led to their acquisition of dangerous properties in
the process of operation, transportation, storage, destruction and disposal, and the measures taken by it;
2) to ensure the safety control of machines and equipment during their operation, destruction and disposal.
8. Along with the duties provided for in paragraph 3 of this Article, the user must:
1) promptly inform the authorized bodies of violations of the safety requirements established by this Law and technical regulations of machines and equipment put into circulation, which led to their acquisition of dangerous properties during operation, transportation, storage, destruction and disposal, and of the measures taken by them.;
2) to ensure the safety control of machinery and equipment during their sale, storage, transportation, destruction and disposal.

This Law regulates public relations in determining, establishing, applying and fulfilling requirements for machines and equipment, their life cycle processes, and establishes the legal basis for ensuring safety to ensure the protection of human life, health and the environment.
