1. The authorized body, within the limits of its powers, has the right:

1) to receive free of charge from subjects of legal statistics and special accounting legal statistical information on issues of state legal statistics and special accounting, departmental reports, documents and forms of primary accounting, as well as other information for the production of statistical information and special accounting;

2) to monitor the integrity, objectivity, reliability and sufficiency of legal statistical information provided by subjects of legal statistics and special accounting, without interfering in their activities not related to the formation of state legal statistics and the maintenance of special accounting;

3) to check the observance of legality, analyze the state of legality, and evaluate acts that have entered into force in the field of state legal statistics and special accounting;

4) Excluded by the Law of the Republic of Kazakhstan dated 05.11.2022 No. 157-VII (effective ten calendar days after the date of its first official publication).

5) refuse to register acts on the appointment of inspections, preventive control with visits to the subject (object) of control and supervision and other forms of state control, as well as supervision provided for by the laws of the Republic of Kazakhstan, subject to registration with the authorized body, in cases of violations of the legislation of the Republic of Kazakhstan when they are appointed;

5-1) provide access to legal statistical information in ways not prohibited by the legislation of the Republic of Kazakhstan;

6) exercise other rights in accordance with the laws of the Republic of Kazakhstan.

2. The authorized body, within the limits of its powers, is obliged to carry out:

1) collection, processing, accumulation, compilation and updating of information in the field of state legal statistics and special accounting;

2) coordination and approval of the program of conducted legal statistical observations with the central executive body responsible for the management of state statistics;

3) provision of legal statistical information to government agencies;

4) providing free of charge legal statistical information, information from special accounts of subjects of legal statistics and special accounts within the limits, volumes and within the time limits established by regulatory legal acts of the Republic of Kazakhstan;

5) information and reference services for individuals and legal entities within the limits, volumes and within the time limits established by regulatory legal acts of the Republic of Kazakhstan, at the expense of their funds received by the republican budget in accordance with the legislation of the Republic of Kazakhstan;

6) the safety of the information received, which constitutes state secrets, personal data and other legally protected secrets;

7) protection of information systems from unauthorized access, damage or destruction of data on objects of legal statistics and special accounting;

8) respect for the rights and legitimate interests of individuals and citizens, legal entities and the state in the formation of state legal statistics and the maintenance of special records;

9) submission, at the request of the authorized financial monitoring body, of information from its own information systems in accordance with the legislation of the Republic of Kazakhstan on countering the legalization (laundering) of proceeds from crime, financing of terrorism and financing the proliferation of weapons of mass destruction;

10) perform other duties stipulated by the laws of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated December 22, 2003 No. 510.

This Law defines the legal basis and principles for the implementation of state legal statistics and special accounting, the powers and functions of the authorized body, subjects of legal statistics and special accounting.
