Article 7. Sources of cost recovery and income generation of the concessionaire of the Law on Concessions - Excluded by the Law of the Republic of Kazakhstan | Kyrgyz Republic Zanymen alynyp tastaldy.
1. The sources of cost recovery and revenue generation of the concessionaire are:
1) sale of manufactured goods (works, services) during the operation of the concession facility;
2) subsidies from the state in cases established by the laws of the Republic of Kazakhstan;
3) compensation of the concessionaire's investment costs in accordance with the budget legislation of the Republic of Kazakhstan;
4) compensation of operating costs of the concessionaire within the scope of expenses for the maintenance of social infrastructure and life support facilities in the relevant branch (sphere) of the economy;
5) remuneration for the management of the concession facility owned by the state, as well as rent for the use of the concession facility owned by the concessionaire, in accordance with the budget legislation of the Republic of Kazakhstan;
6) payment for the availability of the concession facility.
2. The fee for the availability of the concession facility is carried out in accordance with the procedure determined by the authorized body for budget execution, and includes payments from budget funds provided for in subparagraphs 3), 4) and 5) of paragraph 1 of this article, made in the form of single payments in certain fractions of the total amount of payments during the entire period of the concession project, taking into account provision by the concessionaire of the technical and operational characteristics of the concession object.
3. The fee for the accessibility of the concession facility may be applied only to concession projects classified as socially significant.
4. The sources of cost recovery and revenue generation of the concessionaire are determined based on the results of a tender (auction) at the concessionaire's choice.
The Law of the Republic of Kazakhstan dated July 7, 2006 No. 167.
This Law defines the legal conditions of the concession, the types of state support for the concessionaire, and regulates public relations arising in the process of concluding, executing, and terminating concession agreements.
