Article 7. The accreditation Body The Law on Accreditation in the field of Conformity Assessment

Article 7. The accreditation Body The Law on Accreditation in the field of Conformity Assessment

      1. Excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 34-V (effective from the date of its first official publication).

      1-1. The accreditation body must meet the following requirements:  

     1) have at least two expert auditors on accreditation in each field of activity.;

      2) be a member of international accreditation organizations;  

     3) not to be affiliated with the subjects of accreditation.

     2. The accreditation Body:

      1) has the right:  

      to involve expert auditors on accreditation, conformity assessment, technical experts and other persons with special knowledge to participate in the work on accreditation;  

      participate in the work of international (regional) non-governmental and non-governmental organizations on accreditation;  

     to organize comparative tests and comparisons of the results of verification and calibration of measuring instruments;

     determine the procedure, criteria and conditions for the application of assessment techniques;

     conduct scheduled and unscheduled assessments;

     monitor the activities of the accredited entities for compliance with the accreditation criteria;

      to carry out certification of expert auditors on accreditation;  

      2) must:  

      establish the forms of the accreditation certificate, appendices to the accreditation certificates, and the accreditation mark;  

     to carry out work on accreditation in compliance with the procedure established by this Law;

     to prevent the disclosure of information constituting a commercial or other legally protected secret that became known during the work on accreditation;

      maintain a register of accreditation entities;  

     maintain and maintain an online resource, officially publish the register of accreditation entities on it, and post regulatory legal acts on accreditation in the field of conformity assessment;

      in case of revocation of the accreditation certificate or termination of the post-accreditation agreement, notify the authorized body in writing within three working days.;  

      to consider applications for renewal of the accreditation certificate, updating of accreditation materials;  

     consider complaints and appeals and make decisions on them within the time limits established by the laws of the Republic of Kazakhstan, and post information on the decisions taken on the Internet resource within no more than ten working days.;

     revoke, return the accreditation certificate and apply to the court for revocation of the accreditation certificate on the grounds and in accordance with the procedure provided for by this Law;

      submit quarterly the results of planned and unscheduled assessments, as well as monitoring of the activities of the accreditation entity to the authorized body;  

     to ensure the enforcement of an effective decision in the case of an administrative offense issued by the court, the department of the authorized body and its territorial divisions regarding the suspension or revocation of the accreditation certificate by entering information into the register of subjects of accreditation;

     comply with the requirements of the international regulatory document regulating the activities of the accreditation body;

     Ensure the implementation and application of documents from specialized international organizations that establish common criteria and rules in the field of accreditation and conformity assessment.

      3. To review the accreditation materials and make decisions on them, the head of the accreditation body creates a permanent commission to review the accreditation materials. The commission's decisions are advisory in nature.  

      The quantitative composition of the commission should be odd, consist of at least three people and include at least one expert auditor for accreditation.  

 

 

The Law of the Republic of Kazakhstan dated July 5, 2008 No. 61-IV.

     This Law regulates public relations in the field of accreditation of conformity assessment bodies, as well as related relations.
