Article 7. The exclusive right to the topology of the Law on the Legal Protection of Integrated Circuit Topologies

Article 7. The exclusive right to the topology of the Law on the Legal Protection of Integrated Circuit Topologies  

      1. The exclusive right to a topology belongs to the author of the topology or to the employer or the customer in the cases provided for in Article 9 of this Law, or to their legal successors.  

      2. The copyright holder has the right to use the topology in any way at his discretion, in particular, by manufacturing integrated circuits with such a topology, including the right to prohibit the use of this topology to other persons without the appropriate permission of the copyright holder, except in cases provided for in Article 10 of this Law.  

      3. The procedure for the use of an exclusive right belonging to several authors of a topology or other copyright holders is determined by an agreement between them.  

      In the absence of such an agreement, each of them may use the protected topology at their discretion, but may not grant a license for it or assign the exclusive right to another person without the consent of the other copyright holders.  

      4. A violation of the exclusive right to a topology is the commission of the following actions without the permission of the copyright holder:  

      1) copying the topology as a whole or part of it by including it in an integrated circuit or otherwise, with the exception of copying only that part of it that is not original;  

      2) the application, importation, offer for sale, sale and other introduction into civil circulation of a topology, an integrated circuit with this topology or a product including such an integrated circuit.
