Article 7. The right of a pupil to protect the rights and legitimate interests of the Law on Family-type Children's Villages and Youth Homes
1. A pupil of a children's village has the right to protect his rights and legitimate interests.
The rights and legitimate interests of the pupil are protected by the administration of the children's village, the guardianship and guardianship authority, the prosecutor and the court, as well as internal affairs bodies and other state bodies within their competence.
2. A pupil of a children's village has the right to be protected from abuse by the administration of the children's village, as well as the mother-educator.
In case of violation of the rights and legitimate interests of the pupil, including in case of non-fulfillment or improper fulfillment by the administration of the children's village, as well as by the mother-educator of the duties to provide him with conditions for the maintenance, upbringing and receipt of primary, basic secondary, general secondary, technical and vocational, post-secondary, higher education, or abuse of their rights, the child has the right to independently apply to the guardianship and guardianship authority for protection of rights and legitimate interests, and upon reaching the age of fourteen, to the court.
3. Officials of organizations and persons who have become aware of a threat to the life or health of a child, a violation of his rights and legitimate interests, are obliged to report this to the guardianship and guardianship authority at the child's actual location. Upon receiving such information, the guardianship and guardianship authority is obliged to take the necessary measures to protect the rights and legitimate interests of the pupil of the children's village.
The Law of the Republic of Kazakhstan dated December 13, 2000 No. 113-II.
This Law defines the legal status of family-type children's villages and youth homes established in order to meet the rights of orphaned children and children left without parental care to live and be raised in a family, as well as to comprehensively ensure their moral, spiritual, labor upbringing and education.
