Article 73. Admission of persons to drive vehicles of the Law on Road Traffic

Article 73. Admission of persons to drive vehicles of the Law on Road Traffic

     1. The Republic of Kazakhstan establishes the following categories and subcategories of vehicles included in them, for which a special right is granted (hereinafter referred to as the right to drive vehicles):

     1) category "A" – motorcycles;

     2) category "B" – cars, the permitted maximum mass of which does not exceed three thousand five hundred kilograms and the number of seats of which, in addition to the driver's seat, does not exceed eight; cars of category "B" coupled to a trailer, the permitted maximum mass of which does not exceed seven hundred and fifty kilograms; vehicles of category "B" coupled to a trailer, the permitted maximum mass of which exceeds seven hundred and fifty kilograms, but does not exceed the mass of the vehicle without load, and the total permitted maximum mass of such a combination of vehicles does not exceed three thousand five hundred kilograms;

     3) category "C" – vehicles, with the exception of those belonging to category "D", the permitted maximum mass of which exceeds three thousand five hundred kilograms; vehicles of category "C" coupled to a trailer, the permitted maximum mass of which does not exceed seven hundred and fifty kilograms;

     4) category "D" – vehicles intended for the carriage of passengers and having more than eight seats, in addition to the driver's seat; category "D" vehicles coupled to a trailer, the maximum permissible mass of which does not exceed seven hundred and fifty kilograms;

     5) category "VE" – vehicles of category "B" coupled to a trailer, the permitted maximum mass of which exceeds seven hundred and fifty kilograms and exceeds the mass of the vehicle without load; vehicles of category "B" coupled to a trailer, the permitted maximum mass of which exceeds seven hundred and fifty kilograms, and the total permitted maximum mass of such a combination of vehicles exceeds three thousand five hundred kilograms;

     6) category "CE" – vehicles of category "C" coupled to a trailer, the maximum permissible mass of which exceeds seven hundred and fifty kilograms;

     7) category "DE" – vehicles of category "D" coupled to a trailer, the maximum permissible mass of which exceeds seven hundred and fifty kilograms, as well as articulated buses;

     8) Tm category – trams;

     9) category "Tb" – trolleybuses;

     10) subcategory "A1" – motorcycles, tricycles, ATVs and mopeds with a maximum design speed of more than fifty kilometers per hour, with an internal combustion engine displacement not exceeding one hundred and twenty-five cubic centimeters, and a maximum power not exceeding eleven kilowatts;

     11) subcategory "In 1" – tricycles and ATVs;

     12) subcategory "C1" – vehicles, with the exception of those belonging to category "D", the permitted maximum mass of which exceeds three thousand five hundred kilograms, but does not exceed seven thousand five hundred kilograms; vehicles of subcategory "C1" coupled to a trailer, the permitted maximum mass of which does not exceed seven hundred and fifty kilograms;

     13) subcategory "D1" – vehicles intended for the carriage of passengers and having more than eight, but not more than sixteen seats, in addition to the driver's seat; vehicles of subcategory "D1" coupled to a trailer, the permitted maximum mass of which does not exceed seven hundred and fifty kilograms;

      14) subcategory "C1E" – vehicles of subcategory "C1" coupled to a trailer, the permissible maximum mass of which exceeds seven hundred and fifty kilograms, but does not exceed the mass of the vehicle without load, and the total permissible maximum mass of such a combination of vehicles does not exceed twelve thousand kilograms;  

     15) subcategory "D1E" – vehicles of subcategory "D1" coupled to a trailer not intended for the carriage of passengers, the maximum permissible mass of which exceeds seven hundred and fifty kilograms, but does not exceed the mass of the vehicle without load, and the total permissible maximum mass of such a combination of vehicles does not exceed twelve thousand kilograms.

      1-1. Persons who meet the requirements established by the second part of paragraph 5 of Article 57 of this Law are allowed to operate electric scooters on the right edge of the carriageway, including in the lane for fixed-route vehicles.

     2. The right to drive vehicles is granted to persons who have passed the exams, subject to the conditions listed in Articles 74 or 74-1 of this Law.

     Exams are taken on vehicles with manual or automatic transmission.

     Persons who have passed the exams on vehicles with a manual transmission are granted the right to drive vehicles of the appropriate category or subcategory with any type of transmission.

     3. Exams are conducted using technical means to control the theoretical knowledge and practical skills of the examinees.

     The composition of the technical controls intended for conducting examinations, the requirements for them, as well as the conditions for their use are established by the authorized body.

      4. Excluded by the Law of the Republic of Kazakhstan dated 29.03.2016 No. 479-V (effective twenty-one calendar days after the date of its first official publication).

     5. The right to drive vehicles is confirmed by a driver's license, and in cases stipulated by the legislation of the Republic of Kazakhstan – by a temporary certificate issued in place of a driver's license for the right to drive a vehicle.

     6. In the Republic of Kazakhstan, national and international driving licenses are issued that comply with the requirements of international treaties of the Republic of Kazakhstan.

     7. A national driver's license is issued for a period of ten years, unless otherwise restricted by the laws of the Republic of Kazakhstan.

     8. The national driver's license for the right to drive vehicles of category "A" also confirms the right to drive vehicles of subcategory "A1" and subcategory "B1" with a motorcycle seat or motorcycle–type steering wheel, category "B" - subcategory "B1" (except for vehicles with a motorcycle seat or motorcycle-type steering wheel), categories "C" – subcategories "C1", categories "D" – subcategories "D1", categories "CE" – subcategories "C1E", categories "DE" – subcategories "D1E".

     9. An international driver's license is issued for a period of up to three years, but not more than the validity period of the national driver's license.

     An international driver's license issued in the Republic of Kazakhstan is invalid for driving vehicles in the territory of the Republic of Kazakhstan.

     10. National and international driver's licenses will not be issued to replace lost (stolen) foreign and international driver's licenses issued in other countries.

     11. Samples of national and international driver's licenses are approved by the authorized body.

     12. If the driver's license specifies restrictions on driving, this driver's license is considered valid provided that the restrictions specified therein are observed.

     13. Persons permanently or temporarily residing, as well as temporarily staying in the territory of the Republic of Kazakhstan, are allowed to drive vehicles on the basis of national driving licenses, and in the absence of such – on the basis of valid international or foreign national driving licenses, subject to the conditions and restrictions listed in paragraphs 14, 15, 16, 17, 18 and 19 of this article.

     14. It is not allowed to drive vehicles on the basis of international or foreign driving licenses when carrying out entrepreneurial or other labor activities related to the performance of work on the direct management of vehicles, with the exception of citizens of the member States of the Eurasian Economic Union.

     15. An international driver's license issued in a foreign country is recognized as valid, provided that it is presented together with the corresponding national driver's license.

     16. A foreign driver's license that does not comply with the requirements of international treaties of the Republic of Kazakhstan is considered invalid.

     17. Foreign and international driving licenses are recognized as valid for driving vehicles in the territory of the Republic of Kazakhstan upon reaching the age of their owners provided for in Article 74 of this Law for the relevant categories and subcategories of vehicles.

     18. The provisions provided for in paragraphs 14 and 17 of this article shall not apply in cases of participation of a vehicle in international traffic.

     19. Foreign and international driver's licenses are recognized as invalid for driving vehicles in the territory of the Republic of Kazakhstan after sixty days from the date of receipt by their owner, who is a foreign citizen or a stateless person, of a residence permit, or after sixty days from the date of entry into the Republic of Kazakhstan of their owner, who is a citizen of the Republic of Kazakhstan.

20. Foreign and international driver's licenses that do not comply with the requirements of international treaties of the Republic of Kazakhstan cannot be exchanged for national and international driver's licenses of the Republic of Kazakhstan.

     Notes.

     1. Self-propelled chassis of vehicles used for the transportation of goods belonging to the relevant categories (subcategories) are equated to vehicles of categories "B", "C" and subcategories "C 1".

     2. The classification of vehicles and their self-propelled chassis listed in this article is determined in accordance with international treaties ratified by the Republic of Kazakhstan.
