Article 8-3. Safety requirements for the operation of ships used for merchant shipping, ports, coastal facilities and structures on waterways of the Merchant Shipping Act
1. Ships, ports, coastal facilities and structures at sea related to the process of merchant shipping are high-risk areas and must comply with the requirements of the legislative acts of the Republic of Kazakhstan and acts of the Government of the Republic of Kazakhstan in the field of merchant shipping.
2. Individuals or legal entities operating ships, ports, coastal facilities and structures at sea must ensure compliance with the requirements of the legislative acts of the Republic of Kazakhstan and acts of the Government of the Republic of Kazakhstan in the field of merchant shipping.
3. The operation of ships used for merchant shipping should not have a negative impact on human life and health and the environment.
4. Small-deck vessels subject to state registration in the ship's register must comply with the requirements of the rules on technical supervision of small-deck vessels.
5. Excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication).
6. The use of vessels subject to state registration in the ship's register and bases (facilities) for their parking is carried out in accordance with the Rules for the Use of Small vessels and bases (facilities) for their parking.
7. Boatmasters of self-propelled vessels subject to state registration in the ship's register must complete training in the boatmaster training program and carry with them a certificate for the right to operate a self-propelled small vessel.
The issuance of a certificate for the right to operate a small vessel, the coordination of the training program for boatmasters and the accounting of training courses for boatmasters of small vessels are carried out by local executive bodies in accordance with the Rules for certification of boatmasters for the right to operate a small vessel.
When opening courses for the training of boatmasters of small vessels, organizations send a notification to the local executive body about the start of activities with an attachment.:
1) copies of diplomas of higher or secondary technical education in specialties in the field of water transport of teaching staff;
2) a training program for the training of boatmasters of small vessels, developed on the basis of a standard training program for boatmasters of small vessels in accordance with the rules for certification of boatmasters for the right to operate a small vessel;
3) copies of the document confirming the existence of the premises owned or leased for the organization of the educational process.
Notification of the beginning or termination of activities for the training of small-size vessel skippers is submitted in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Permits and Notifications".
Organizations that have opened training courses for boatmasters of small vessels are required to send to the local executive body lists of persons who have successfully completed training under the training program for boatmasters of small vessels. The procedure for providing information about persons who have completed training is determined by the rules of certification of boatmasters for the right to operate a small vessel.
The Law of the Republic of Kazakhstan dated January 17, 2002 No. 284.
This Law defines the legal, organizational, economic and international foundations of public administration in the field of merchant shipping and regulates relations related to the transportation of passengers, baggage and cargo, ensuring safety in maritime transport and environmental protection.
