Article 8-4. Organization of vessel traffic management The Merchant Shipping Act

     1. Maintenance by the navigation center of vessels is carried out in the following order:

     1) emergency vessels, vessels following to provide assistance, and vessels with seriously ill people on board;

     2) scheduled ferries and passenger vessels;

     3) ships with perishable cargoes;

     4) tugboats with towed objects;

     5) ships with dangerous goods;

     6) ships of the line;

     7) other vessels in accordance with the time of receipt of applications.

     2. The radar wiring of vessels is carried out by the navigation center at the request of the vessel under any visibility conditions.

     3. The procedure for radar wiring is agreed with the captain of the seaport before the start of radar wiring.

     4. The movement of vessels in the areas of the vessel traffic management system (entry into the zone, anchoring, anchor removal, approach and mooring to and from the pier, re-mooring, and others) is carried out with the permission of the captain of the seaport.

     5. Vessels proceeding from the sea, before approaching the area of operation of the vessel traffic control system, establish radio communication on ultrashort waves with a navigation center that regulates traffic in this area.

     6. During the establishment of radio communication with the navigation center, the ship informs:

     1) type, name and nationality (flag) of the vessel;

     2) the time of approach to the zone;

     3) speed in maneuver mode;

     4) Destination port;

     5) gross tonnage and basic dimensions according to the measuring certificate;

     6) the actual precipitation;

     7) type and quantity of cargo;

     8) information about the condition of the ship's radar station;

     9) information about existing restrictions affecting the safety of navigation and maneuvering.

     7. Vessels on the move carry a permanent radio watch (duty) on the working channel of the navigation center in the area of which they are located, unless another channel is specified.

     8. The radio exchange of the navigation center with ships, as well as current radar information, are documented. The records are stored for three days. If there have been emergencies or accidents, the records are kept until the end of the investigation.

     9. The use of the navigation center's services is carried out on a paid basis at tariffs (prices) approved by the authorized body in accordance with the legislation of the Republic of Kazakhstan on state property.

     This Law defines the legal, organizational, economic and international foundations of public administration in the field of merchant shipping and regulates relations related to the transportation of passengers, baggage and cargo, ensuring safety in maritime transport and environmental protection.
