Article 8. Age classification of films of the Law on Cinematography

Article 8. Age classification of films of the Law on Cinematography

     1. For all films produced in the Republic of Kazakhstan and films imported (delivered) to the territory of the Republic of Kazakhstan for the purpose of distribution, an age classification is carried out with the assignment of the following age categories:

     1) "up to 6 years old" - films intended for children under the age of six;

     2) "from the age of 6" - films intended for children over the age of six;

     3) "from the age of 12" - films intended for children over the age of twelve;

     4) "from the age of 14" - films intended for children over the age of fourteen;

     5) "from the age of 16" - films intended for children over the age of sixteen;

     6) "from the age of 18" - films intended for viewers over the age of eighteen;

     7) "from the age of 21" - films intended for viewers over the age of twenty-one.

      2. The criteria for classifying films into the age categories "under 6 years old", "from 6 years old", "from 12 years old", "from 14 years old" and "from 16 years old" correspond to the criteria provided for in the Law of the Republic of Kazakhstan "On the Protection of children from information harmful to their health and development".  

      The "from 18 years old" age category includes films containing:  

      information harmful to the health and development of children, with the exception of information prohibited by the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan;

     descriptions and (or) depictions of suicide, murder, problems of family life and divorce, drug and alcohol addiction, diseases, antisocial behavior, nudity, scenes of sexual intercourse or other erotic acts, provided they are justified by the plot and the artistic purpose of the film production;

     occasional use of rude slang words, swearing, profanity.

     The "from 21 years old" age category includes films:

      containing descriptions and (or) images of any scenes, with the exception of information prohibited by the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan;

     They do not contain restrictions on the use of rude slang words, swearing, or profanity.

     3. Film distribution on TV channels with the age category "from 18 years old" is allowed after 22 hours to 06 a.m. local time, with the age category "from 21 years old" - after zero hours to 06 a.m. local time, with the exception of films distributed on a paid basis using decoding technical devices.

     The rental of a film with the age category "from 21 years old" in the territory of the Republic of Kazakhstan is allowed in cinemas and other places designated for these purposes after 22 hours to 06 a.m. local time.

     4. Individuals or legal entities who have received a rental certificate and/or who rent films in the territory of the Republic of Kazakhstan are required to inform the viewer about the age category of the film.

     5. The sign of the age category of films "up to 6 years old", "from 6 years old", "from 12 years old", "from 14 years old", "from 16 years old" and "from 18 years old" must comply with the requirements provided for by the legislation of the Republic of Kazakhstan on the protection of children from information harmful to their health and development.

     The sign of the age category of films "from the age of 21" is indicated by the sign "21 +" in a diamond and (or) a text warning in the form of the phrase "for viewers over the age of twenty-one".

     6. Information about the age category of the film must be indicated and accessible to viewers in accordance with the requirements of the legislation of the Republic of Kazakhstan on the protection of children from information harmful to their health and development.

 

 

     This Law regulates public relations and defines the legal, economic and organizational foundations of the field of cinematography.
