Article 8. Competence of local representative and executive bodies of the Law on the Prevention of Juvenile Delinquency and the Prevention of Child Neglect and Homelessness
1. Local representative bodies within their competence:
1) approve and monitor the execution of local budgets in terms of expenses for the prevention of offenses, neglect and homelessness among minors;
2) approve the composition of the commissions on juvenile affairs and protection of their rights;
3) exercise other powers in accordance with the legislative acts of the Republic of Kazakhstan to ensure the rights and legitimate interests of minors.
2. Local executive bodies organize their work in the field of prevention of offenses, neglect and homelessness among minors in accordance with local levels of government and within the competence established by legislative acts of the Republic of Kazakhstan.
3. Local executive bodies of the region (cities of republican significance, capitals):
1) submit for approval to the relevant maslikhats the personal composition of the commissions on juvenile affairs and protection of their rights and organize their work;
2) maintain regional medical and social records;
3) take measures in accordance with the procedure established by the legislation of the Republic of Kazakhstan on labor and household arrangements, providing other assistance to minors in need of special social services.;
4) provide organizational and methodological assistance to non-profit and other organizations whose activities are related to the implementation of measures to prevent offenses, neglect and homelessness among minors, promote a healthy lifestyle, and improve legal literacy among adolescents;
4-1) they contain, in accordance with the procedure established by the law of the Republic of Kazakhstan, neglected and street minors aged from three to eighteen years old, minors left without parental care or persons replacing them, minors selected by the guardianship and guardianship authority from their parents (one of them) in the order established by the law of the Republic of Kazakhstan or from other persons in whose care they are, minors sent to special educational institutions, as well as minors, those in need of special social services due to abuse that led to social maladaptation and social deprivation;
4-2) minors with deviant behavior between the ages of eleven and eighteen are detained in special educational institutions in accordance with the procedure established by the law of the Republic of Kazakhstan.;
5) ensure the formation of social infrastructure for minors, including organizations that perform functions for the protection of children's rights, and monitor their activities.
4. Local executive bodies of districts (cities of regional significance):
1) submit for approval to the relevant maslikhats the personal composition of the commissions on juvenile affairs and protection of their rights and organize their work;
2) keep personal medical and social records;
3) assist in the formation of social infrastructure for minors;
4) take measures in accordance with the procedure established by the legislation of the Republic of Kazakhstan on labor and household arrangements, providing other assistance to minors in need of special social services.;
5) provide organizational and methodological assistance to non-profit and other organizations whose activities are related to the implementation of measures to prevent offenses, neglect and homelessness among minors, promote a healthy lifestyle, and improve legal literacy among adolescents.
