Article 8. Competence of state bodies The Law on the Procedure for Organizing and Holding Peaceful Assemblies in the Republic of Kazakhstan
1. The authorized body in the field of interaction between the state and civil society develops and approves the forms of distinctive signs of the organizer of peaceful assemblies.
2. Local representative body of a city of republican significance, capital or district (city of regional significance):
1) defines specialized places for organizing and holding peaceful assemblies, the procedure for using specialized places for organizing and holding peaceful assemblies, the norms of their maximum occupancy, as well as the requirements for the logistical and organizational support of specialized places for organizing and holding peaceful assemblies;
2) defines the boundaries of the adjacent territories in which picketing is prohibited;
3) exercises other powers in accordance with the legislation of the Republic of Kazakhstan to ensure the rights and legitimate interests of citizens.
3. Local executive body:
1) consider notifications of peaceful assemblies or applications for approval within the time limits established by Articles 11 and 13 of this Law.;
2) based on the results of consideration of the notification of holding peaceful assemblies or an application for approval, inform the organizers of peaceful assemblies of the decision taken within the time limits established by Articles 11 and 13 of this Law.;
3) in the event of a threat to state security, public order, health protection, protection of the rights and freedoms of others, refuses to establish tents, yurts, structures, the use of sound-amplifying equipment, vehicles during peaceful assemblies;
4) suggests to the organizer of peaceful assemblies other place and (or) route or time of holding peaceful assemblies in cases and within the time limits established by Articles 11 and 13 of this Law.;
5) depending on the form of peaceful assemblies and the number of participants, appoints its representatives in order to assist the organizer of peaceful assemblies in holding peaceful assemblies in accordance with this Law.;
6) provides information on the measures taken to organize and hold peaceful assemblies to the organizers and participants of peaceful assemblies;
7) requires the organizer of peaceful assemblies to suspend or terminate peaceful assemblies in accordance with Articles 17 and 18 of this Law;
8) suspend or terminate peaceful assemblies in the cases provided for in Articles 17 and 18 of this Law.;
9) in the absence of a response on the consent or disagreement of the organizer of peaceful assemblies with the change of the place and (or) route or time of peaceful assemblies, expressed in writing or electronically, makes a decision to refuse to hold peaceful assemblies.;
10) post on its Internet resource a list of specialized places for organizing and holding peaceful assemblies, as well as information about their employment;
11) exercises other powers assigned to him by the legislation of the Republic of Kazakhstan.
4. The rights and duties of law enforcement agencies are determined by the laws of the Republic of Kazakhstan.
