Article 8. Legal status of special institutions and special Premises of the Law on the Procedure and Conditions of Detention of Persons in Special Institutions, Special Premises Providing Temporary Isolation from Society

1. Pre-trial detention facilities have the rights of a legal entity.

They are created, reorganized and liquidated by the decision of the Government of the Republic of Kazakhstan.

2. Temporary detention facilities are created, reorganized and liquidated depending on their departmental affiliation, respectively, by the decision of the Minister of Internal Affairs of the Republic of Kazakhstan and the Chairman of the National Security Committee of the Republic of Kazakhstan.

3. Distribution receivers and special receivers are created, reorganized and liquidated by the decision of the Minister of Internal Affairs of the Republic of Kazakhstan.

Upon the introduction of a state of emergency, other premises that meet sanitary requirements and exclude the possibility of their unauthorized abandonment, adapted for the detention of persons who do not have a specific place of residence and (or) identity documents, or who have been subjected to administrative arrest, may be used as distribution receivers and special receivers by decision of the commandant of the area.

4. Special premises are created at police duty stations by the decision of the Minister of Internal Affairs of the Republic of Kazakhstan.

5. Financing of special institutions and special premises is carried out at the expense of budgetary funds.

The Law of the Republic of Kazakhstan dated March 30, 1999 No. 353-I.

This Law defines the legal basis for the activities of special institutions and special premises that legally provide temporary isolation from society, as well as establishes the rights and obligations of the persons contained therein.
