When carrying out state quarantine phytosanitary control and supervision, state plant quarantine inspectors have the right:

1) to detain, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, quarantined products and objects of state quarantine phytosanitary control and supervision for the period of inspection, inspection, quarantine phytosanitary examination and (or) laboratory examination and, if necessary, disinfection, destruction, as well as during their transportation without a phytosanitary or quarantine certificate or in cases of non-compliance quarantine phytosanitary requirements;

1-1) prohibit the import, export and transit of quarantined products that do not comply with quarantine phytosanitary requirements and (or) the requirements of the legislation of the Republic of Kazakhstan in the field of plant quarantine;

2) to visit and conduct inspections of state quarantine phytosanitary control and supervision facilities for compliance with the requirements of the legislation of the Republic of Kazakhstan, to obtain the information necessary for the exercise of their powers in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

3) to take samples of quarantined products for quarantine phytosanitary examination and (or) laboratory examination;

4) to issue instructions to individuals and legal entities, as well as officials of local executive bodies, on the elimination of identified violations of the legislation of the Republic of Kazakhstan in the field of plant quarantine, on carrying out necessary plant quarantine measures;

5) to bring to administrative responsibility officials, individuals and legal entities who have committed violations of the legislation of the Republic of Kazakhstan in the field of plant quarantine;

6) excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).

The Law of the Republic of Kazakhstan dated February 11, 1999 No. 344.

This Law defines the legal basis, goals, objectives and principles of plant quarantine measures, which are an integral part of the national security system, on the territory of the Republic of Kazakhstan.
