Article 85. Appointment of elections of deputies of the Mazhilis of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. The basis for the appointment:

     1) regular elections are the end of the constitutional term of office of the deputies of the Mazhilis;

     2) early elections - early termination of the powers of the Parliament or the Mazhilis of Parliament;

     3) election of deputies instead of those who have retired - early termination of the deputy's powers, deprivation of the deputy's mandate or his death.

     2. Election of deputies in the case provided for in subparagraph 1) 1 of this Article, are appointed by the President of the Republic at least five months in advance and are held no later than two months before the end of the term of office of the deputies of the Mazhilis.

     3. Election of deputies in the case provided for in subparagraph 2) 1 of this Article, are appointed by the President of the Republic simultaneously with his decision on early termination of the powers of the Parliament or the Mazhilis of Parliament and are held within two months from the date of early termination of the powers of the Parliament or the Mazhilis of Parliament.

     The date of commencement of the period during which early elections of deputies are to be held is the date of the enactment of the act of the President of the Republic on the dissolution of Parliament or the Mazhilis of Parliament. This period ends at the end of two months. If the deadline falls on a month that does not have a corresponding date, the deadline expires on the last day of that month.

     3-1. Excluded by the Constitutional Law of the Republic of Kazakhstan dated 05.11.2022 No. 156-VI (effective ten calendar days after the date of its first official publication).

     4. In the cases specified in subparagraph 3) According to paragraph 1 of this article, the election of deputies to replace those who have retired shall be appointed by the Central Election Commission no later than three months from the date of early termination and deprivation of the deputy's mandate or his death.

     5. The date of the election is determined taking into account the requirements of paragraph 3 of Article 41 of the Constitution.
