Article 87. Enhanced supervision regime of the Law on Banks and Banking Activities in the Republic Kazakhstan
1. The enhanced supervision regime refers to a special supervision procedure applied to a bank by decision of an authorized body in order to prevent deterioration of the bank's financial stability.
2. During the period of enhanced supervision, in addition to the supervisory response measures provided for in Article 78 of this Law, the authorized body may:
1) receive information, financial and other reports, including through a data showcase, with an individually determined frequency;
2) to assess (analyze) the financial and property condition of the bank, including by visiting the bank and (or) involving appraisers, auditing and (or) other specialized organizations, whose services are paid (reimbursed) at the expense of the bank;
3) to analyze the bank's resilience to adverse macroeconomic conditions;
4) require the bank to review and update the financial stability recovery plan in accordance with the current financial situation of the bank;
5) require the bank, major participants of the bank, and bank holdings to take measures to improve the financial stability of the bank and (or) the banking conglomerate, including increasing the equity capital of the bank and (or) the banking conglomerate in an amount sufficient to ensure the financial stability of the bank and (or) the banking conglomerate;
6) require the bank and (or) the bank holding company to suspend certain types of operations and (or) certain transactions with organizations in which the bank and (or) the bank holding company participate, as well as organizations that are part of a banking conglomerate, if such operations and (or) transactions negatively affect (may affect) the financial stability of a bank, a bank holding company and (or) a banking conglomerate;
7) require organizations that are part of a banking conglomerate to suspend certain types of operations and (or) certain transactions with their affiliates if such operations and (or) transactions negatively affect (may affect) the financial stability of the bank and (or) the bank holding company and (or) the banking conglomerate.;
8) require the bank to improve its corporate governance and/or risk management and internal control systems;
9) require the bank and (or) the bank holding company to eliminate other grounds for applying enhanced supervision to the bank.
3. The powers provided for in paragraph 2 of this Article shall be applied by the authorized body in the form of a written order, taking into account the requirements established by paragraphs 3, 5 and 6 of Article 80 of this Law.
4. The decision of the authorized body on the application of enhanced supervision regime to the bank is brought to the attention of the bank, major participants of the bank, bank holdings, the National Bank of the Republic of Kazakhstan within three working days from the date of the decision and is not subject to dissemination (disclosure) by the specified persons.
5. The bank, major participants of the bank, and bank holding companies are required to take the necessary (sufficient) measures to eliminate the reasons that were the basis for applying the enhanced supervision regime to the bank.
6. The enhanced supervision regime is terminated by a decision of the authorized body upon elimination of the grounds for its application and the bank's compliance with equity adequacy ratios and other prudential standards and limits established by the authorized body, as well as macroprudential standards and limits established by the National Bank of the Republic of Kazakhstan for six consecutive calendar months.
7. The provisions of this article apply to branches of non–resident banks of the Republic of Kazakhstan.
For the purposes of part one of this paragraph, major bank participants and bank holding companies are understood to be the governing body of a non–resident bank of the Republic of Kazakhstan with a branch in the territory of the Republic of Kazakhstan.
