Article 9-1. Requirements for road safety of the Law on Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan
1. The implementation of architectural, urban planning and construction activities should be based on the conditions for ensuring the requirements for territorial transport planning and traffic management established by the legislation of the Republic of Kazakhstan.
Measures to meet these requirements should be reflected in the project documentation for territorial transport planning and traffic management.
2. The urban planning and architectural and construction documentation includes sections (parts) of projects on territorial transport planning and traffic management.
Compliance with the requirements (conditions, restrictions) of the project documentation on territorial transport planning and traffic management approved in accordance with the established procedure is mandatory for all subjects of architectural, urban planning and construction activities implementing projects.
3. Settlements and territories should be provided with comprehensive project documentation on territorial transport planning and traffic management.
4. In localities, the results of monitoring traffic accidents and the capacity of roads and streets are reflected in the state urban planning cadastre at the basic level.
5. Sections (parts) of projects on territorial transport planning and traffic management contain the following types of documents:
1) substantiating materials for the development of transport sections of integrated schemes, master plans (conceptual proposals for traffic management, integrated transport schemes, research and forecasts) – They carry out research on the operation of transport systems, foci and causes of road accidents, evaluate previously developed design solutions for the expected accident rate, develop proposals to reduce traffic accidents by redistributing traffic loads, reclassifying the road network, building new sections of the road network, and restricting traffic;
2) integrated transport scheme – distributes the volume of transport work between individual and public transport, offers comprehensive solutions for the development of street and road networks and public transport networks, networks of off-street high-speed traffic;
3) the general scheme of the road network - defines the financial and economic aspects of the implementation of the tasks of developing an efficient and safe road network in accordance with the territorial planning documents (territorial planning schemes and master plans);
4) the road network organization project – implements the specified structure of the main road network, determines the locations of streets, roads and nodal elements, transverse and longitudinal profiles, traffic patterns at the nodes with the condition of ensuring road safety requirements. Defines the necessary territories for the placement of streets and roads;
5) draft road layout – determines the location of the main elements of streets and roads within the boundaries of allotments (red lines), reserved territories, taking into account the requirements of road safety;
6) integrated traffic management scheme – defines the traffic management system within the framework of the adopted project for the organization of the road network and the adopted street layout projects in conjunction with the movement of public transport.
6. Territorial transport planning and traffic management are carried out in three stages:
At the first stage, studies of the current transport situation are conducted, forecasts of changes in the transport situation for the long term are carried out, the possibilities of developing the transport framework of the territory are assessed, proposals from the Ministry of Defense of the Republic of Kazakhstan are requested and conceptual proposals for the organization of traffic for the long term are formed with the allocation of the first stage. Comprehensive transport schemes are being developed for cities with a population of more than one hundred thousand people and other cities with difficult transport situations.;
At the second stage, research results, conceptual proposals and integrated transport schemes are formulated in the form of substantiating materials and are considered as part of the development of territorial planning schemes for the territory of the Republic of Kazakhstan and individual regions (region or any part of it), master plans of settlements. The result of the development of these documents are general traffic management schemes in conjunction with other materials of territorial planning schemes and master plans.;
At the third stage, comprehensive traffic management schemes are being developed based on general traffic management schemes.
7. The road network organization project is the link between the master plan (territorial planning document), the road layout project and the integrated traffic management scheme.
8. The road layout project is the basis for the development of a traffic management project at individual junctions.
9. The design of roads in the territory of the Republic of Kazakhstan must meet the following mandatory safety requirements:
the required capacity of roads, taking into account the prospect of increasing traffic intensity;
roads with intelligent transport systems;
unhindered and safe movement of public transport, including by allocating separate lanes for them.;
unhindered and safe movement of bicycles, including by allocating separate bicycle lanes or bike lanes to them;
equipping roads with highway medical and rescue points;
pedestrian crossings.

This Law regulates the relations that arise between government agencies, individuals and legal entities in the process of carrying out architectural, urban planning and construction activities in the Republic of Kazakhstan, and is aimed at creating a full-fledged human habitat and vital activity, sustainable development of settlements and interuniverse territories.
