Article 9. Admission to service in the bodies of the diplomatic service of the Law on the Diplomatic Service of the Republic of Kazakhstan
1. A citizen of the Republic of Kazakhstan who has a higher education, is fluent in Kazakh, Russian and foreign languages and has the appropriate business, moral, professional qualities and health status to fulfill the duties assigned to him may be appointed to a diplomatic position.
2. The Minister of Foreign Affairs of the Republic of Kazakhstan is appointed and dismissed by the President of the Republic of Kazakhstan.
Ambassadors Extraordinary and Plenipotentiary of the Republic of Kazakhstan, permanent (plenipotentiary) representatives of the Republic of Kazakhstan to international organizations are appointed and dismissed by the President of the Republic of Kazakhstan.
If the charters or other documents of an international organization provide that permanent (authorized) representatives to international organizations are not appointed by the heads of State, then the Permanent (Authorized) Representative of the Republic of Kazakhstan to the international organization does not have the status of a political civil servant.
Ambassadors Extraordinary and Plenipotentiary of the Republic of Kazakhstan may be authorized by the President of the Republic of Kazakhstan to represent the Republic of Kazakhstan in relations with several foreign States and international organizations concurrently.
By the decision of the President of the Republic of Kazakhstan, Ambassadors Extraordinary and Plenipotentiary of the Republic of Kazakhstan may be appointed with a location in the Republic of Kazakhstan.
The procedure for organizing the activities of Ambassadors Extraordinary and Plenipotentiary of the Republic of Kazakhstan concurrently and Ambassadors extraordinary and plenipotentiary of the Republic of Kazakhstan with their location in the Republic of Kazakhstan is determined by the President of the Republic of Kazakhstan.
The Deputy Ministers of Foreign Affairs of the Republic of Kazakhstan and heads of departments are appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.
Appointments to other positions and dismissals from the diplomatic service in the Ministry of Foreign Affairs are made by the Minister of Foreign Affairs of the Republic of Kazakhstan.
Appointments to other positions and dismissals from diplomatic service in foreign institutions are made by the Minister of Foreign Affairs of the Republic of Kazakhstan.
Appointment to positions of the diplomatic service is carried out in accordance with the procedure provided for by this Law, the Law of the Republic of Kazakhstan "On the Civil Service of the Republic of Kazakhstan".
3. Admission to service in the bodies of the diplomatic service is carried out after receiving positive results of a special check.
4. The staff of the diplomatic service, who returned to the Republic of Kazakhstan after working abroad, shall be appointed on a rotating basis to a position not lower than that which he held in the Ministry of Foreign Affairs, if he was not subject to penalties provided for in Article 22 of this Law.
4-1. Diplomatic service personnel who were in the diplomatic service immediately prior to their appointment to a position in an international organization, upon completion of their work in an international organization, are appointed to a position not lower than the one they held in the Ministry of Foreign Affairs, without competitive selection, within three months from the date of their dismissal from their position in an international organization.
This paragraph does not apply to persons who held a political government position immediately prior to their appointment to a position in an international organization.
5. For persons entering the diplomatic service for the first time, a mandatory probation period is established in accordance with the procedure established by the legislation of the Republic of Kazakhstan in the field of public service.
6. Persons may not be admitted to the bodies of the diplomatic service in cases stipulated by the legislation of the Republic of Kazakhstan in the field of public service.

This Law defines the legal basis, as well as the procedure for organizing the activities of the diplomatic service of the Republic of Kazakhstan.
