The competence of the foreign intelligence agency, in addition to the provisions provided for in Article 8 of this Law, also includes:

1) providing intelligence information to the President, Parliament and Government of the Republic of Kazakhstan, state bodies and state organizations of the Republic of Kazakhstan;

2) assistance in the implementation of the policy of the state leadership in political, military-political, financial-economic, scientific-technical, humanitarian, environmental and other areas affecting the national interests of the Republic of Kazakhstan;

3) making proposals to the President and the Government of the Republic of Kazakhstan on improving foreign intelligence;

4) coordination of intelligence activities of foreign intelligence entities;

4-1) ensuring the interaction of state bodies and organizations of the Republic of Kazakhstan within the framework of the activities of the intelligence community of the Republic of Kazakhstan, provided for in Article 12-1 of this Law;

7) development of strategy and tactics of ongoing intelligence activities;

8) development and approval of regulatory legal acts on intelligence activities;

9) interaction with other national security forces of the Republic of Kazakhstan, as well as with government agencies and organizations of the Republic of Kazakhstan. The procedure for interaction of the foreign intelligence agency with the interested state bodies of the Republic of Kazakhstan is determined by joint regulatory legal acts, and with organizations of the Republic of Kazakhstan, regardless of their forms of ownership, is established by agreement.;

9-1) carrying out intelligence activities in accordance with the legislation of the Republic of Kazakhstan;

10) establishment, maintenance and development of contacts, conclusion of cooperation agreements with special services, law enforcement agencies, government and special communications agencies of foreign states, international law enforcement organizations on the basis of international treaties of the Republic of Kazakhstan;

12) detention of persons who have committed offenses at its facilities, with their subsequent transfer to law enforcement agencies;

13) organization and provision of protection of information constituting state secrets, implementation of information security, physical and engineering protection of its facilities;

14) equipping foreign institutions of the Republic of Kazakhstan with special types of communications, development and implementation of engineering and technical protection, measures to prevent leakage through technical channels of information constituting state secrets;

15) development, organization and implementation of measures to ensure mobilization readiness;

16) selection, conducting a special check of citizens of the Republic of Kazakhstan to make a decision on recruitment or work in the foreign intelligence agency, registration (re-registration) for employees enrolled in the staff and employees of access to information constituting state secrets, training, retraining and advanced training of personnel in educational institutions and research institutions of the Republic of Kazakhstan, as well as in educational institutions of other countries, including special ones;

17) conducting scientific research in the field of intelligence activities;

18) organization of scientific and methodological support, creation of expert groups in accordance with the main directions of their activities with the involvement of researchers and specialists in various fields of knowledge working in other government agencies, organizations and institutions;

20) the use of documents, other methods and means that encrypt the departmental affiliation of departments, facilities, premises, vehicles, employees and employees, persons providing confidential assistance;

20-1) in order to encrypt the identity of employees and persons providing confidential assistance to the foreign intelligence agency, the departmental affiliation of units, facilities, premises and vehicles, the production and registration for use outside the Republic of Kazakhstan of documents of other state bodies, as well as organizations, regardless of their forms of ownership, the procedure for the production and (or) registration of which is determined by the head of the body foreign intelligence.

20-2) taking the necessary measures to ensure secrecy in the conduct of intelligence and other operational search activities, in the sale of materials reflecting the results of these activities, as well as preventing the declassification of information sources through the administrative activities of the head of the foreign intelligence agency or an official authorized by him, ensuring that access to materials of operational activities is restricted until they are publicly disclosed the form, in accordance with the legislation of the Republic of Kazakhstan;

23) the admission of individuals and legal entities after their examination and verification to work on the protection and maintenance of their facilities;

24) the use of weapons, special means and physical force to ensure the protection of their facilities and premises in accordance with the laws of the Republic of Kazakhstan;

26) participation in resolving issues of admission to citizenship of the Republic of Kazakhstan and granting political asylum;

28) the exercise of other powers determined by the laws and acts of the President of the Republic of Kazakhstan.

This Law defines the status, competence and organization of activities of foreign intelligence entities of the Republic of Kazakhstan and members of the intelligence community of the Republic of Kazakhstan.
