Article 9. Electoral systems of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. During the elections of the President and deputies of the Senate of the Parliament, the candidate is considered elected.:

     who received more than fifty percent of the votes of the electors (electors) who took part in the voting;

     the candidate who received a higher number of votes of the electors who took part in the second ballot than the other candidate.

     2. Deputies of the Mazhilis of the Parliament are elected according to a mixed electoral system.: according to the system of proportional representation in the territory of a single national electoral district, as well as in single-mandate territorial electoral districts.

     In elections of deputies of the Mazhilis of Parliament in single-mandate territorial electoral districts, a candidate is considered elected if a larger number of voters who participated in the voting voted for his candidacy than other candidates.

     3. Deputies of maslikhats of regions, cities of republican significance and the capital are elected according to a mixed electoral system.: According to the proportional representation system, half of the deputies are elected in a single territorial electoral district, and the other half in single–mandate territorial electoral districts.

     When electing deputies of maslikhats of regions, cities of republican significance and the capital in single-mandate territorial electoral districts, a candidate is considered elected if a larger number of voters who took part in the voting voted for his candidacy than other candidates.

     In the case of an odd number of mandates of deputies of maslikhats of regions, cities of republican significance and the capital, a mandate exceeding half is elected in a single-mandate territorial electoral district.

     4. Deputies of maslikhats of districts and cities of regional significance are elected in single-mandate territorial electoral districts.

     In the elections of deputies of maslikhats of districts and cities of regional significance, the candidate who has received a higher number of votes than other candidates who took part in the voting is considered elected.

     5. In the election of the mayor, the candidate who receives a higher number of votes than other candidates who took part in the voting is considered elected.

     6. In the case of elections of members of other local self-government bodies, candidates who were voted for by a larger number of voters than other candidates who took part in the voting are considered elected.
