Article 9. Functions of the Commission The Law on the Return of Illegally Acquired Assets to the State
1. The main functions of the commission are:
1) development of recommendations on systemic measures aimed at eliminating the causes and conditions of the illegal acquisition of assets, as well as their withdrawal from the Republic of Kazakhstan;
2) developing recommendations on ways and mechanisms for returning assets to the state and (or) involving them in legitimate economic turnover in the Republic of Kazakhstan;
3) consideration of information about assets and other information confirming the legality of the sources of acquisition (origin) of the declared assets;
4) the formation of the registry, taking into account socio-economic risks and other factors.
2. The Commission develops recommendations on the assets of legal entities included in the list of city–forming legal entities approved by the authorized body for regional development, taking into account the need to ensure social, political and economic stability.
The recommendations specified in the first part of this paragraph are subject to mandatory approval by the Government of the Republic of Kazakhstan.
3. The recommendations of the commission are mandatory for consideration by the authorized body for asset recovery.
This Law, in the interests of current and future generations of Kazakhstanis, regulates public relations to identify and return illegally acquired assets to the state (hereinafter referred to as asset recovery) in order to restore the violated rights of the people of Kazakhstan, ensure the rule of law, social justice, and sustainable economic and social development of Kazakhstan for the benefit of its people.
