Article 9. National Preventive Mechanism of the Constitutional Law on the Commissioner for Human Rights in the Republic of Kazakhstan

Article 9. National Preventive Mechanism of the Constitutional Law on the Commissioner for Human Rights in the Republic of Kazakhstan

     1. In order to coordinate the activities of the participants of the national preventive mechanism for the prevention of torture and other cruel, inhuman or degrading treatment or punishment, the Commissioner for Human Rights in the Republic of Kazakhstan:

     Takes measures to ensure the necessary capacity and professional knowledge of the participants of the national preventive mechanism by organizing their selection, training and exchange of experience;

     Ensures the establishment of a Coordinating Council and its interaction with the Subcommittee on Prevention of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of the United Nations Committee against Torture;

     interacts with the Commissioner for Children's Rights in the Republic of Kazakhstan and other national human rights institutions;

     engages specialists and exercises other powers in accordance with the legislation of the Republic of Kazakhstan.

     2. The Commissioner for Human Rights in the Republic of Kazakhstan facilitates the preparation and publication of the annual consolidated report of the participants of the national preventive mechanism, organizes its discussion with authorized state bodies and monitoring the implementation of the recommendations specified therein.

     3. Based on the reports of the participants of the national preventive mechanism on the results of preventive visits, the Commissioner for Human Rights in the Republic of Kazakhstan has the right to apply to authorized state bodies or officials with a request to initiate disciplinary or administrative proceedings or criminal proceedings against an official who violated the rights and freedoms of a person and citizen of the Republic of Kazakhstan.

     This Constitutional Law defines the legal status and organization of the activities of the Commissioner for Human Rights in the Republic of Kazakhstan.
