Article 9. Powers of the authorized body for state planning The Law On Concessions is excluded by the Law of the Republic of Kazakhstan | Kyrgyz Republic Zanymen alynyp tastaldy.

     Authorized body for State Planning:

      1) engages a specialized organization on concession issues, with the exception of the cases established by subparagraph 3-2) of Article 13 of this Law, to conduct:

     examination of the tender (auction) documentation, including when making changes and additions to it;

     examination of concession applications submitted by the participants of the tender (auction) during the tender for the selection of the concessionaire;

     examination of concessionaire's proposals for obtaining state guarantees;

     assessment of the implementation of concession projects;

     2) formulates and approves the list of objects proposed for concession related to republican ownership;

     3) coordinates the tender (auction) documentation and concession agreements, including when making amendments and additions to them, except for the cases established by subparagraph 3-3) of Article 13 of this Law.;

      4) excluded by the Law of the Republic of Kazakhstan dated 24.11.2011 No. 495-IV (effective after ten calendar days after its first official publication);

     5) approves the methodology for determining the value of the concession object and the total cost of state support for concessionaires' activities and sources of cost recovery;

      6) excluded by the Law of the Republic of Kazakhstan dated 03.12.2013 No. 150-V (effective from 01.01.2014);

     7) defines the requirements for the examination of the tender (auction) documentation, including when making changes and additions to it, concession applications submitted by the bidders during the tender (auction) at the concessionaire's choice.;

     7-1) carries out intersectoral coordination and methodological guidance in the field of organization of concession projects;

     7-2) sends the results of the assessment of the implementation of concession projects to the authorized state body for the exercise of the right to dispose of republican property in order to enter data into the register of concession agreements for concession facilities related to republican ownership;

     7-3) formulates limits of state concession obligations of the Government of the Republic of Kazakhstan and local executive bodies;

     7-4) maintains a register of concession agreements;

     7-5) approves the rules for conducting a tender (auction) at the concessionaire's choice;

     7-6) Approves the rules for the submission, review and selection of concession projects;

     7-7) is excluded by the Law of the Republic of Kazakhstan dated 02.01.2021 No. 399-VI (effective after ten calendar days after the date of its first official publication);  

      7-8) approves the rules for monitoring concession agreements, monitoring and evaluating the implementation of concession projects;  

      7-9) approves criteria for classifying concession projects as socially significant;  

     7-10) approves criteria for classifying concession projects as concession projects of special importance;

     7-11) defines organizations for financing concession projects;

     7-12) approves the rules for the payment of rent for the use of the concession facility;

     8) performs other functions stipulated by this Law, other laws, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

 

 

The Law of the Republic of Kazakhstan dated July 7, 2006 No. 167.

     This Law defines the legal conditions of the concession, the types of state support for the concessionaire, and regulates public relations arising in the process of concluding, executing, and terminating concession agreements.
