Article 9. Radio frequency authorities of the Republic of Kazakhstan The Law on Communications
1. The radio frequency authorities responsible for the distribution, allocation and assignment of frequency bands, radio frequencies (radio frequency channels) in the Republic of Kazakhstan are:
authorized body of the Republic of Kazakhstan;
The Ministry of Defense of the Republic of Kazakhstan.
2. The main functions of the authorized body in regulating the radio frequency spectrum are:
1) development of regulatory legal acts on the distribution and use of the radio frequency spectrum for the use of radio-electronic means and high-frequency devices within its competence;
2) organization of work on technical expertise of allocated frequency bands, radio frequencies (radio frequency channels);
3) issuance of a permit for the use of the radio frequency spectrum in the territory of the Republic of Kazakhstan for radio-electronic devices and (or) high-frequency devices for civil purposes;
4) excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 36-V (effective after ten calendar days after its first official publication);
5) suspension of the operation of radio-electronic means and high-frequency devices in cases of their non-compliance with established documents on standardization and technical standards, creating a threat to the safety of citizens, the environment, as well as when performing particularly important work and activities in accordance with the legislation of the Republic of Kazakhstan;
6) implementation of radio monitoring in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
7) organization of measures to eliminate radio interference by radio-electronic means, including radio-electronic means of international organizations and foreign states operating in accordance with international treaties;
8) the assignment of frequency bands, radio frequencies (radio frequency channels) and the implementation of measures for the international coordination of radio frequencies in accordance with the Radio Regulations of the International Telecommunication Union;
9) maintaining an electronic database of assigned civilian radio frequency bands.
10) excluded by the Law of the Republic of Kazakhstan dated December 28, 2017 No. 128-VI (effective ten calendar days after the date of its first official publication).
3. The Ministry of Defense of the Republic of Kazakhstan, in accordance with the national Frequency Band Allocation Table, conducts the necessary approvals for the allocation and use of the radio frequency spectrum in the sharing ranges for civilian radio electronic equipment, and also ensures the regulation of the use of the radio frequency spectrum and related radio electronic equipment in order to meet the needs of defense and security of the state.
The Law of the Republic of Kazakhstan dated July 5, 2004 No. 567.
This Law establishes the legal basis for activities in the field of communications in the territory of the Republic of Kazakhstan, defines the powers of state bodies to regulate these activities, the rights and obligations of individuals and legal entities providing or using communications services.
