Article 9. Rights of the State Security Service of the Republic of Kazakhstan Law On the State Security Service of the Republic of Kazakhstan
The State Security Service of the Republic of Kazakhstan grants the right to perform the duties assigned to it.:
1) perform a personal search of civilians (with the exception of protected persons) at the entrance (entrance) to protected objects and at the exit (exit) from them, an inspection of objects located with them, an inspection of vehicles and things carried on them, including with the use of technical means. Prohibit the bringing of an object and a case to protected objects. The list of items and cases to be brought to protected facilities is determined by the Head of the State Security Service of the Republic of Kazakhstan.;
1-1) to carry out photographing, sound recording, film and video recording of facts and events during security measures;
2) to make proposals and (or) proposals for the elimination of deficiencies that contribute to the perfection of offenses that infringe on the life, health, right, freedom, honor, dignity and property of protected persons;
2-1) to inspect and admit individuals and legal entities to work on the protection and maintenance of protected persons and facilities;
2-2) when conducting an anti-terrorist operation and ensuring the legal regime of an anti-terrorist operation, apply the measures and time restrictions provided for by the Law of the Republic of Kazakhstan "On Countering Terrorism;
2-3) to realize the full extent of the established laws of the Republic of Kazakhstan;
2-4) to carry out, in accordance with the laws of the Republic of Kazakhstan "On operational search activities" and "On Counterintelligence activities", operational search and counterintelligence activities for the security of protected persons and facilities;
2-5) establish additional requirements for organizations of anti-terrorist protection of facilities associated with terrorism, intended for the stay of protected persons;
3) to use, on a contractual basis, official landowner organizations, military formations, as well as annual and other premises for civil, transport, communications and foreign property;
4) request, in accordance with the established procedure, and receive from government agencies, organizations independent of the form of ownership, and the military the emerging information necessary to accomplish the tasks set;
5) organize and carry out sanitary, hygienic, environmental, radiation, biological, chemical and anti-epidemic control in buildings, structures, landfills intended for the placement of protected persons and in the territories adjacent to them, as well as at protected facilities;
5-1) organize and carry out combat duty to ensure the safety of protected persons, the protection and defense of protected objects, determine the procedure for organizing and conducting security measures, as well as, in coordination with government agencies, the composition of forces and means involved in security measures;
6) ensure your own safety;
7) allow employees of the State Security Service of the Republic of Kazakhstan who have received special training to store and carry service weapons and special equipment;
8) send employees and (or) military personnel of the state security of the Republic of Kazakhstan on official business trips, including to foreign countries;
9) carry out training and advanced training of personnel on a contractual basis in educational institutions and research institutions under the jurisdiction of the Ministry of Defense, the Ministry of Internal Affairs, the National Security Committee of the Republic of Kazakhstan, as well as in educational institutions of other states, including special ones;
9-1) to provide education, training and retraining of employees and military services of the state security, the Armed Forces, other troops and military formations, law enforcement and special state bodies of the Republic of Buryatia of Kazakhstan in the field of security, as well as in accordance with international treaties of special services of foreign states;
10) ensure the operation and maintenance of facilities on balance, organize sanitary, hygienic, environmental and anti-epidemic control on them;
10-1) create separate units within the location of the State Security Service that are not subject to registration with an incomplete body;
11) to provide Civil assistance in ensuring the safety of protected persons, to present them to the state awards of the Republic of Kazakhstan in accordance with the procedure established by law.;
12) to involve the civilian Republic of Kazakhstan on a voluntary basis as external operational staff of the State Security Service of the Republic of Kazakhstan;
13) involvement, if necessary, of forces and means of internal, special state bodies, as well as other state bodies of the Republic of Kazakhstan, to participate in security measures. The procedure for attracting government agencies to participate in security measures is approved by joint regulatory legal acts.
The State Security Service of the Republic of Kazakhstan is the organizing and coordinating body in addressing the issues of ensuring the safety of protected persons.
