1. State control in the field of seed production is carried out by state inspectors for seed production and is aimed at ensuring compliance with the legislation of the Republic of Kazakhstan on seed production, national standards and other regulatory documents in the field of seed production.

2. State control in the field of seed production provides for:

1) excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 36-V (effective after ten calendar days after its first official publication);

2) varietal and seed control;

3) control over the activities of certified seed production entities for compliance with their licensing requirements approved by the authorized body;

4) excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 36-V (effective after ten calendar days after its first official publication);

5) control over the state testing of agricultural plant varieties.

3. Varietal and seed control includes:

1) control over the implementation of measures for the production, harvesting, processing, storage, sale, transportation and use of seeds for compliance with the rules and regulations of seed production in the following periods:

sowing;

vegetation of agricultural plants;

cleaning services;

backfilling of seeds;

seed storage;

sales (verification of seed lots prepared for sale and sold, including during export and import, for compliance with their quality supporting documents).

The control of seed production from seed producers certified in accordance with the established procedure includes the following stages::

inspection of fields prepared for sowing seeds - once a year before sowing;

inspection of varietal crops during the growing season - three times a year;

control of approbation and field surveys of varietal and hybrid crops - once during the approbation period;

control of collection (harvesting), transportation, processing (cleaning) and storage of seeds, readiness of seed storage facilities - twice for each type of control per year;

2) control over the examination of varietal and sowing qualities of seeds by laboratories for the examination of seed quality, their compliance with regulatory legal acts and documents on standardization in the field of seed production:

twice a year during the seed quality examination period, as well as in the order of control during public procurement of seed quality examination services;

in cases of claims against seed producers, as well as disagreement with the results of seed research on varietal and seed qualities issued by seed quality testing laboratories;

3) during the testing period, the work of the approbators, as well as seed producers, is checked for compliance with the norms of paragraph 2 of Article 14 of this Law.;

4) control over compliance by seed production entities with regulatory legal acts, standardization documents and other regulatory documents in the field of seed production.

4. State control in the field of seed production is carried out in the form of inspection and preventive control with a visit to the subject (object) of control in accordance with the Business Code of the Republic of Kazakhstan.

5. Excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication).

This Law defines the legal, economic and organizational bases for carrying out activities in the field of seed production and is aimed at regulating the organization and functioning of the seed production system and state control over the production, harvesting, processing, storage, transportation, sale and use of seeds of agricultural plants.
