Article 9. Termination of powers of a judge of the Constitutional Court of the Constitutional Law On the Constitutional Court of the Republic of Kazakhstan
1. The powers of a judge of the Constitutional Court shall be terminated as a result of:
1) submitting an application for dismissal at his own request;
2) termination of citizenship of the Republic of Kazakhstan or obtaining a residence permit or other document confirming the right to permanent residence in the territory of a foreign state;
3) the entry into force of a court verdict of conviction against him;
4) recognition of his incapacity or limitation of his legal capacity by a court decision that has entered into legal force;
5) recognizing him as missing by a court decision that has entered into legal force;
6) his death or declaration as deceased by a court decision that has entered into legal force;
7) appointments in violation of the requirements established by the Constitution of the Republic of Kazakhstan and this Constitutional Law;
8) violations of the requirements of the Constitution of the Republic of Kazakhstan and this Constitutional Law established for judges of the Constitutional Court;
9) expiration of the term of office established by the Constitution of the Republic of Kazakhstan;
10) non-participation of a judge in sessions of the Constitutional Court at least three times in a row without valid reasons.
2. Termination of the powers of the Chairman of the Constitutional Court is carried out by the President of the Republic of Kazakhstan on the grounds provided for in paragraph 1 of this Article.
3. The termination of the powers of judges of the Constitutional Court shall be carried out respectively by the President of the Republic of Kazakhstan, the Senate of the Parliament of the Republic of Kazakhstan, the Mazhilis of the Parliament of the Republic of Kazakhstan on the grounds provided for in paragraphs 1), 2), 7), 8), 9) and 10) of paragraph 1 of this article.
4. Termination of the powers of a judge of the Constitutional Court on the grounds provided for in subparagraphs 3), 4), 5) and 6) of paragraph 1 of this Article shall be carried out by the Constitutional Court.
5. The dismissal of the Deputy Chairman of the Constitutional Court does not entail the termination of his powers as a judge of the Constitutional Court.
